Introduction
•Short title and commencement
•(1) These rules may be called the Central
Civil Services (Leave)Rules, 1972.
•(2) They shall come into force on the 1st
day of June, 1972.

Introduction
•Extent of application Save as otherwise provided in these rules, these rules
shall apply to Government servants appointed to the civil services and posts
in connection with the affairs of the Union, but shall not apply to-
•(a) Railway servants;
•(b) persons in casual or daily-rated or part-time employment;
•(c) persons paid from contingencies;
•(d) workmen employed in industrial establishments;
•(e) persons employed in work-charged establishments;
•(f) members of the All India Services;
•(g) persons locally recruited for service in Diplomatic, Consular or other
Indian establishments in foreign countries;
•(h) persons employed on contract except when the contract provides
otherwise;
•(i) persons in respect of whom special provisions have been made by or
under the provisions of the Constitution or any other law for the time being
in force;
•(j) persons governed, for purposes of leave, by the Fundamental Rules or
the Civil Service Regulations;

General Principles
•Right to Leave
Leave cannot be claimed as matter of Right
MayberefusedorrevokedbyduetoexigenciesbutcannotbealteredexceptonrequestofGS.Provided
thatleaveappliedunderRule20,shallnotberefusedorrevokedwithoutreferencetotheMedical
Authority,whoseadviceshallbebinding.
•Regulationofclaimtoleave:-AGovernmentservant‘sclaimtoleaveisregulatedbytherulesinforceatthe
timetheleaveisappliedforandgranted
•Effectofdismissal,removalorresignationonleaveatcredit:-AnyclaimtoleavetothecreditofGSwhois
dismissedorremovedorwhoresignsfromserviceceasesfromthedateofsuchdismissalorremovalor
resignation.(Notontechnicalresignation)
•Commutationofonekindofleaveintoanother:Leavegrantedmaybecommutedretrospectivelyintoleave
ofadifferentkindwhichwasdueandadmissibletohimatthetimetheleavewasgranted,butthe
Governmentservantcannotclaimsuchcommutationasamatterofright.Requesttobemadewithin30
daysofjoiningthedutyafterleave.
•CombinationofdifferentkindsofleaveExceptasotherwiseprovidedintheserules,anykindofleave
undertheserulesmaybegrantedincombinationwithorincontinuationofanyotherkindofleave.
Casualleaveisnotrecognizedasleaveundertheserulesshallnotbecombinedwithanyotherkindof
leaveadmissibleundertheserules
•No employee shall be granted leave of any kind for a continuous period exceeding five years.
•Applicationforleave:WrittenformbyGStoCA.IncaseofdisabilityofGS,spouse,parents(unmarried
GS),childorbrotherorsister(notminor)
•Prefixingandsuffixingholidaystoleaveotherthanleaveonmedicalcertificatesshallbeallowed
automatically.

General Principles
•Grant of leave on medical certificate to Gazetted and non-Gazetted Government servants
GazettedGS-MedicalCertificateinForm3givenbyadoctorinaCentralGovernmentHealth
SchemeDispensaryorbyaGovernmentHospitalorbyanAuthorizedMedicalAttendantifheis
notaCentralGovernmentHealthSchemebeneficiaryandbyanAuthorizedDoctoroftheprivate
hospitalrecognizedunderCentralGovernmentHealthSchemeorCentralServices(Medical
Attendance)Rules,1944,incaseofhospitalizationorindoorspecializedtreatmentinrespectof
anyparticularkindofdiseaselikeheartdisease,cancer,etc.,forthetreatmentOfwhichthe
concernedhospitalhasbeenrecognizedbytheMinistryofHealthandFamily
IfGazettedGSawayfromCGHSareaorproceedondutyoutsideHQ,Medical/Fitnesscertificate
inForm3&5byAMA.
Non-GazettedGS
•CAmayobtainSecondmedialopiniontoexaminetheapplicantmedicallyregardingfactsof
illnessandnecessityofamountofleave
•MedicalCertificatedoesnotconferrighttoleave.
•CAmaywaiveproductionofMedicalCertificateforleavenotexceeding03days.Leavetobe
treatednotonMedicalGround.
•LeavetoaGovernmentservantwhoisunlikelytobefittoreturntoduty

SUMMARY OF LEAVE RULES
•Recalltodutybeforeexpiryofleave:-Mayberecalled
beforeexpiryofleaveandsuchrecalltodutyshallbe
treatedascompulsory.GSwouldbetreatedonduty
fromthedateonwhichhestarts,wouldbeentitledfor
TA,LeaveSalary
•Returnfromleave:-Anemployeeonleaveshallnot
returntodutybeforetheexpiryofperiodofleave
grantedtohimunlesshepermittedtodosobythe
authoritywhichgrantedhimleave.
•Anemployeeonleaveshouldnottakeupanyservice
oremploymentelsewherewithoutobtainingprior
sanctionoftheappointingauthority
•Vacationcanbecombinedwithanykindofleavebut
thedurationofvacationandearnedleaveshouldnot
exceed180daysatatime.

•Absence after expiry of leave:-GS will not
be entitled for any leave salary. The period
be debited from HPL to the extent due and
further as EOL. GS liable for disciplinary
action for wilful absence from duty after
leave.

Grant of leave on Medical grounds:
(i)ACGHSbeneficiaryshouldproducemedicalcertificate/
fitnesscertificatefromaCGHSdoctor.
(ii)Non-CGHSbeneficiaryandCGHSbeneficiarieswho
proceedoutsidetheHeadquarteronduty,leave,
etc.,shouldproducethecertificatefromAMA,and in
suchcases,anon-GazettedGovernmentservantmay
producecertificatefromRMPifthereisnoAMAavailable
withinaradiusof8kmsof`hisresidence.
(iii)Whereanon-GazettedGovernmentservantfindsitdifficult
toobtainMC/FCfromCGHS/AMA,theleavesanctioning
authoritymayconsidergrantofleaveonthebasisofthe
certificatefromanRMPaftertakingintoaccountthe
circumstancesofthecase.

Earned Leave
•Advancecreditintwoinstallmentsof15dayseachonthefirstdayofJanuaryandJulyofevery
calendaryear
•Theleavecarriedforwardplusthecreditforthehalf-yearwillbelimitedto300days

Earned Leave
•Creditwillbeaffordedinadvanceatauniformrateof15
days/(10daysHPL)onthe1stofJanuaryand1stofJuly
everyyear.
•WhenaGovernmentservantjoinsanewpostwithout
availingfulljoiningtimeprovidedEL&JTnot300.
•Thecredittobeaffordedwillbereducedby1/10thof
EOLavailedand/orperiodofdiesnonduringthe
previoushalf-year,subjecttoamaximumof15days.
•Theleavecarriedforwardplusthecreditforthehalf-year
willbelimitedto300days.
•Thecreditforthehalf-yearinwhichanemployeeis
appointedwillbeaffordedattherate2-1/2daysforeach
completedcalendarmonthofservicewhichheislikelyto
renderinthecalendarhalf-yearinwhichheisappointed.

Earned Leave
• Thecreditforthehalfyearinwhichanemployeeisduetoretireor
resignsfromtheservicewillbeaffordedattherateof2-1/2daysper
completedcalendarmonthinthathalf-yearuptothedateof
retirement/resignation.
• Thecreditforthehalf-yearinwhichanemployeeisremoved/dismissed
fromservice,willbeaffordedattherateof2-1/2dayspercompleted
calendarmonthuptotheendofthecalendarmonthprecedingthe
calendarmonthinwhichheisremoved/dismissed.
• WhenaGovernmentservantdieswhileinservice,creditofearnedleave
shallbeallowedattherateof2½dayspercompletedmonthofservice
uptothedateofdeathoftheGovernmentservant.
• IfaGovernmentservanthasavailedofextraordinaryleaveand/orsome
periodofabsencehasbeentreatedasdiesnoninahalf-year,thecredit
tobeaffordedtohisleaveaccountatthecommencementofthenexthalf
yearshallbereducedby1/10thoftheperiodofsuchleaveand/ordies
nonsubjecttomaximumof15days.

Earned Leave
•Whileaffordingcredit,fractionofadayshouldbe
roundedofftothenearestdayi.e.7-1/2daystobe
roundedas8days.
•Earned leave can be accumulated upto 300 days.
•Earned leave be taken up to 180 days at a time.
•Earnedleaveexceeding180daysbutnotexceeding
300daysmaybegrantedtoGroup'A'andGroup'B'
Officerscontinuously,iftheentireleaveoratleastthe
amountofleaveinexcessof180daysisspentoutside
India.
•Earnedleavemaybetakenatatimeupto300days
inthecaseofleavepreparatorytoretirement.

Half Pay Leave
•Halfpayleaveiscreditedinadvanceat
therateof10daysonthe1stofJanuary
and1stofJulyeveryyear.
•Thecreditforthehalfyearinwhichan
employeeisappointedwillbeattherate
of5/3daysforeachcompleted
calendarmonthofserviceheislikelyto
renderinthehalfyearinwhichheis
appointed.

Half Pay Leave
• Thecreditforthehalfyearinwhichanemployeeisduetoretire/resigns
willbeaffordedattherateof5/3daysforeachcompletedcalendar
monthsinthathalfyearuptothedateofretirement/resignation.
• Thecreditforthehalfyearinwhichanemployeeisremoved/dismissed
fromservicewillbeaffordedattherateof5/3dayspercompleted
calendarmonthsuptotheendofthecalendarmonthprecedingthe
calendarmonthinwhichheisremoved/dismissed.
• WhenaGovernmentservantdieswhileinservice,creditofhalfpayleave
shallbeallowedattherateof5/3dayspercompletedmonthofservice
uptothedateofdeathoftheGovernmentservant.
• Halfpayleavecanbetakeneitherwithorwithout-medicalcertificate.
•WhereaperiodofabsenceorsuspensionofaGovernment
servanthasbeentreatedasdiesnoninahalf-year,thecreditto
beaffordedtohishalfpayleaveaccountatthecommencementof
nexthalf-year,shallbereducedbyone-eighteenthoftheperiodof
diesnonsubjecttoamaximumoftendays

Half Pay Leave
•Thegrantofhalfpayleavetoatemporaryofficialis
subjecttothesanctioningauthoritysatisfyinghimself
hewillreturntodutyafteritsexpiry.
•Thisconditionisnotapplicablewheresuchofficialis
declaredcompletelyandpermanentincapacitatedfor
furtherservice.
•Halfpayleavecanbeconvertedintofullpayleaveby
takingitsas'Commutedleave'iftheleaveappliedfor
isonmedicalcertificate.
•Maximumof180daysforanapprovedcourseofstudy
certifiedtobeinpublicinterest.
•Maximumof120daysmaybetakenascommuted
leavewithoutmedicalcertificateincontinuationof
maternityleave.

Commuted Leave
•NotexceedinghalftheamountofHPLduecanbetakenon
medicalcertificate.
•Ifcommutedleaveistakentwicethenumberofdaysavailed
shouldbedebitedinthehalfpayleaveaccount.
•Maximumof90daysforanapprovedcourseofstudy
•60dayscanbegrantedtoafemaleemployeeincontinuationof
maternityleave/adoptionofchild.
•Cannotbegrantedasleavepreparatorytoretirement.
•Anemployeegrantedcommutedleavequitsservicevoluntarilyor
resignswithoutreturningtoduty,thecommutedleaveshallbe
treatedasHPLandtheexcessleavesalaryrecovered.
• Iftheretirementisbyreasonofill-healthincapacitatinghimfor
furtherserviceorintheeventofdeath,recoveryshouldnotbe
made.
•Commutedleavemaybegrantedattherequestoftheemployee
evenwhenearnedleaveisduetohim.

Leave Not due
•LeaveNotDuemaybegrantedtoaGovernmentservantinpermanent
employorquasipermanentemploylimitedtoamaximumof360days
duringtheentireserviceonmedicalcertificatesubjecttothefollowing
conditions:-
(a)Theauthoritycompetenttograntleaveissatisfiedthatthereis
reasonableprospectoftheGovernmentservantreturningtodutyonits
expiry;
(b)LeaveNotDueshallbelimitedtothehalfpayleaveheislikelyto
earnthereafter;
(c)LeaveNotDueshallbedebitedagainstthehalfpayleavethe
Governmentservantmayearnsubsequently.
Fortemporaryemployee,grantedfor360daysonlyifheissuffering
fromT.B.,Leprosy,cancerorMentalillnessandtherequestforsuch
leaveissupportedbyaMedicalcertificate.Further,heshouldhaveput
inaminimumofoneyearserviceandthepostfromwhichheproceeds
onleaveshouldbelikelytolasttillhisreturntoduty.

Leave Not due
•LeavenotduewillbedebitedagainsttheHPLthatan
employeemayearnsubsequently.
•Whenanemployeegrantedleavenotdueresigns/retire
voluntarilyfromservice,theleavenotdueshouldbe
cancelled.
•Theresignationorretirementwilltakeeffectfromthe
dateonwhichsuchleavehadcommencedandthe
leavesalaryshouldberecovered.
•Whereanemployeewho,havingavailedhimselfof
leavenotdue,returnstodutybutresignsorretiresfrom
servicebeforehehasearnedsuchleave,heshallbe
liabletorefundtheleavesalarytotheextenttheleave
hasnotbeenearnedsubsequently.
•Leavesalarywillnotberecoverediftheretirementisby
reasonofill-healthincapacitatingtheGovernment
servantforfurtherserviceorintheeventofhisdeathor
ifheisretiredprematurely.

Extraordinary leave
•ExtraordinaryleavemaybegrantedtoaSangathan
employeeinspecialcircumstances:-
–when no other leave is admissible.
–when other leave is admissible, but the employee applies in
writing for the grant of extraordinary leave.
•Extraordinaryleavecannotbegrantedtorun
concurrentlywiththenoticeperiod,incaseofofficials
goingonvoluntaryretirement.
•AnyamountofE.O.L.maybesanctionedtoa
permanentemployeeaslongasthecontinuousspell
ofallkindsofleavedoesnotexceedfiveyears.

Extraordinary leave
ExtraordinaryleavemaybegrantedtoaGovernmentservant(otherthanamilitaryofficer)
inspecialcircumstances-(a)whennootherleaveisadmissible:(b)whenotherleaveis
admissible,buttheGovernmentservantappliesinwritingforthegrantofextraordinary
leave.
Allemployee–upto3monthswithorwithoutmedicalcertificate
Minimum of one year's continuous service
i)Upto6monthswithmedicalcertificateforcommonailments.
ii)Up to 18 months with medical certificate for cancer, mental illness,
pulmonary tuberculosis or pleurisy of tubercular origin, tuberculosis of any
part of the body and leprosy, cancer, mental illness
• Completedthreeyears'continuousservice-upto24months,wheretheleaveis
requiredforthepurposeofprosecutingstudiescertifiedtobeinthepublicinterest.
• Twospellsofextraordinaryleave,intervenedbyanyotherkindofleave,shouldbe
treatedasonecontinuousspellforthepurposeofapplyingthemaximumlimit.
• EOLmayalsobegrantedtoregularizeperiodsofabsencewithoutleave
retrospectively.

Leave salary
•Duringearnedleave:Equaltopaydrawnimmediately
beforeproceedingonleave.
•Duringhalfpayleaveorleavenotdue:Equaltohalf
theamountofleavesalaryonearnedleave.
•Duringcommutedleave:Equaltopaydrawn
immediatelybeforeproceedingonleave.
•Extraordinaryleave:Noentitledtoanyleavesalary.
•Note:'Pay'means'Pay'asdefinedinF.R.9(21)and
includesdeputationallowance.

Maternity Leave
•AfemaleGovernmentservant(includinganapprentice)
withlessthantwosurvivingchildrenmaybegranted
maternityleavebyanauthoritycompetenttograntleave
foraperiodof(180days)fromthedateofits
commencement
•Totalof45daysintheentireservice(irrespectiveof
survivingchildren)incaseofmiscarriageincluding
abortiononproductionofmedicalcertificate.
•Theleaveisnotdebitedtotheleaveaccount.
•Itisgrantedonfullpay.
•Maternityleavemaybecombinedwithleaveofanyother
kinddueandadmissible(includingcommutedleavefora
periodnotexceeding60daysandleavenotdue)uptoa
maximumoftwoyearmay,ifappliedfor,begrantedin
continuationofmaternityleavegranted.
•UnmarriedfemaleGSalsoeligibleformaternityleave.

Paternity Leave
•MaleGS(includingapprentice)withlessthantwo
survivingchildren.Itisnottoberefusednormally.
•Itmaybegrantedupto15daysduringwife's
confinementi.e.upto15daysbeforeorupto6months
fromthedateofdeliveryofthechild.
•Theleaveisnotdebitedtotheleaveaccount.
•Itmaybecombinedwithanyotherkindofleave.
•Leavesalaryshallbeequaltothelastpaydrawn.
•Ifnotavailedduringtheperiod,lapsed.
•AlsoavailabletomaleGSincaseofvalidadoptionof
achildbelowtheageofoneyearwithsameterms&
conditionsasabove.

Child Adoption Leave
•Female GS with fewer than two surviving children, on valid adoption
of a child below the age of one year, for a period of 180 days
immediately after the date of valid adoption.
•Incontinuationofthechildadoption,leaveofthekinddueand
admissible(includingleavenotdueandcommutedleavenot
exceeding60dayswithoutproductionofmedicalcertificate)fora
perioduptooneyearreducedbytheageoftheadoptedchildonthe
dateofvalidadoption,withouttakingintoaccountchildadoption
leave.Providedthatthisfacilityshallnotbeadmissibleincaseshe
isalreadyhavingtwosurvivingchildrenatthetimeofadoption.
•LeavesalarysameasMaternityLeave.

Casual Leave
•Casualleaveisnotarecognizedformofleaveand
isnotsubjecttoanyrulesmadebytheGovernment
ofIndia.
•Anofficialoncasualleaveisnottreatedasabsent
fromdutyandhispayisnotintermitted.
•CasualleavecanbecombinedwithSpecialCasual
Leavebutnotwithanyotherkindofleave.
•Itcannotbecombinedwithjoiningtime.
•SundaysandHolidaysfallingduringaperiodof
casualleavearenotcountedaspartofCasual
leave.
•Sundays/publicholidays/restrictedholidays/weekly
offscanbeprefixed/suffixedtocasualleave.

Casual Leave
•Casualleavecanbetakenwhileontour,but
nodailyallowancewillbeadmissibleforthe
period.
•Casualleavecanbetakenforhalfdayalso.
•Essentialintendedforshortperiods.Itshould
notnormallybegrantedformorethan5
daysatanyonetime.
•L.T.C.canbeavailedduringCasualleave.
•Entitlement-percalendaryearis8days.
•Officialsjoiningduringthemiddleofayear
may availleaveproportionatelyorthefull
periodatthediscretionofthecompetent
authority.

Special Casual Leave
•Specialcasualleavemaybegrantedonthefollowingcircumstances:-
SportsEvents
ForCulturalActivities,Mountaineering/Trekking
Expeditions
ForUnion/AssociationActivities
ForNaturalCalamities,Bandhsetc
MeetingsconnectedwithCo-operativeSocieties
ActivitiesinconnectionwithKendriyaSachivalaya
HindiParishad
DuringElections
Differently-abledCentralGovernmentemployees:
SpecialCasualLeavenotmorethan10daysina
calendaryear

Special Casual Leave
•For Family Planning:
(a)Male employees:
•(i)Maximumof5workingdaysadmissiblefor
vesectomyoperation.
•(ii)secondtimeduetofailureofthefirst,anothersix
dayswillbeadmissibleontheproductionofmedical
certificate.
•(ii)Maximumof21daysforundergoingrecanalisation
operation.
•(iii)Maximumof3daysifhiswifeundergoes
tubectomy,laproscopyorsalping-ectomyoperation.
Theleaveshouldfollowthedateofoperation.

Special Casual Leave
•For Family Planning
(b)Female employees:
•Maximumof10daysadmissiblefortubectomy/laproscopy.
•Secondtimeduetofailureofthefirst,maximumof10days
willbeadmissible.
•Minimumof10daysadmissibleforsalpingectomy
operationafterMedicalTerminationofPregnancy(MTP).
•AdmissibleonthedayofIUCDinsertion-insertion.
•Maximumof21daysadmissibleforundergoing
recanalisationoperation.
•Towomenemployeesforoneday,ontheday,their
husbandundergovasectomyoperationtoenablethemto
attendontheirhusbands.

•FemaleorSingleMaleGS.Total730daysduringtheirentireservicefortaking
careofuptotwochildren.SingleMaleGSincludeunmarriedorwidoweror
divorcee.
•Forrearingortolookafteranyoftheirneedslikeexamination,sickness,etc.
•Child:below18yearsorofanyageincaseofdisability.
•Maximum3spellsinacalendaryear.IncaseofsinglefemaleGS,6spells
•Shallnotordinarilybegrantedduringtheprobationperiodexceptinextreme
situationswheretheleavesanctioningauthorityissatisfiedabouttheneedofchild
careleavetotheprobationer,providedthattheperiodforwhichsuchleaveis
sanctionedisminimal.
•Minimumperiod5daysatatime.
•Leavesalary:-100%forfirst365daysand80%fornext365days.
•CCLmaybecombinedwithleaveofanyotherkinddue&admissible(including
CommutedLeavenotexceedingsixtydaysandLeaveNotDue)uptoamaximumof
oneyearincontinuationwithCCL.
•Notbedebitedagainsttheleaveaccount.
Child Care Leave

Child Care Leave
•CCLCannotbedemandedasmatterofrightand
tobeavailedonlyafterpriorsanction.
•CanbeavailedevenifELatcredit.
•GSonCCLmaybepermittedtoleaveHQandmay
proceedonforeigntravel
•LTCmaybeavailedwhileonCCL.

Work Related Illness and Injury
Leave(WRIIL)
•GS(whetherpermanentortemporary),whosuffersillnessorinjury
thatisattributabletooraggravatedintheperformanceofofficial
dutiesorinconsequenceofofficialposition.
•Conditions:-
Fullpayandallowancesshallbegrantedtoallemployeesduringthe
entireperiodofhospitalizationonaccountofWRILL
Beyondhospitalization,WRIILshallbegovernedasfollows:-
(a)AGS(otherthanamilitaryofficer)—fullpayandallowancesforthe
sixmonthsimmediatelyfollowinghospitalizationandHalfPayfor
twelvemonthsbeyondthesaidperiodofsixmonths.TheHalfPay
periodmaybecommutedtofullpaywithcorrespondingnumberof
daysofHalfPayLeavedebitedfromtheemployeesleaveaccount.
(b)NoEarnedLeaveorHalfPayLeaveshallbecreditedduringthe
periodthatemployeeisonWRIIL.
