Introduction An Act is a legal document enacted by the parliament The Nurses & Midwives Act was published 1995 Contained in Malawi Gazette Supplement as number 16 Revised in 2008
The provision of Nurses & Midwives Act The act provides for the establishment of the nurses & Midwives Council of Malawi , the registration and disciplining of nurses/midwives and nursing/midwifery technicians, the licensing of private practice, the regulation of education and training of nurses/midwives and nursing/midwifery technicians and generally for the control and regulation of the nursing profession and practice in Malawi.
Composition of Nurses & Midwives Council 1. The principal secretary for the ministry of health (ex-officio member) 2. The controller of Nursing services in the ministry of health (ex-officio) 3. The Principal of KCN (ex-officio) 4. President of NONM (ex-officio) 5. Medical Council representative
Cont.. 6. Executive Director CHAM 7. Solicitor General 8. Registrar, PMPB 9. Five nurses and one nurse technician elected by NONM
Structure of NMCM
Departments Registrar & Chief Executive M& E and Inspections Education & Training Examination and Registration Administration and Finance
Committees 1. Executive Committee Consists of chairpersons of all committees Exercise powers to perform all functions of the council
Cont.. 2. Education & examination committee Advises the council on all matters relating to education and training requirements of nursing Ensures that graduates will have sufficient basic knowledge, skills and attitudes for the practice of their profession
Cont.. 3. The investigation and Disciplinary committee Investigates any matter delegated to it by the council Consider and investigates any matter of alleged negligence, malpractice, any offence Cancel registration of the registered person
Cont.. 4. Appointments and Finance committee Overseers management of finances of the council Appoints and recruit secretariat staff
Cont.. 5. Professional Practice committee Advises the council on all matters related to the professional practice of nursing and midwifery Develop minimum nursing practice standards Monitor nursing/midwifery practice standards
Functions of the NMCM Promotion and improvement of the health of the population of Malawi Control and exercise authority affecting the education, training and practice pursed by all nurses and midwives Disciplinary control over the professional conduct of all persons registered under the Act
Cont.. Promote standards of education and training Advise the Minister of health on any matter within the scope of the act Communicate to the Minister any information acquired by the council relating to matters of health
Powers of the council Remove from, restore to register any name of nurse/midwife Appoint examiners and moderators, set and conduct examinations and grant certificates Carry out inspections in order to approve application for training colleges Acquire, hire, borrow money on the security of assets of the council
Cont.. Perform any duties as directed by the Minister of health Issue or renew a license to carry on the business of a nursing agency Consider any matter affecting the nursing or midwifery profession Recognize a qualification held by a nurse/midwife as being equal to the prescribed qualification
Offenses Unregistered persons practicing as a nurse or midwife technician Use title ‘nurse’ , symbol, dress and leading any person to false qualifications Falsification of registers Persons conducting education, training without authority Employment of unregistered persons Practicing out of scope of practice
