LEGAL ASPECT OF DISASTER NURSING Healthcare providers are faced with increasing ethical challenges in providing care for patients during times of disaster and other public health emergencies. The code of ethics for most healthcare professions is somewhat ambiguous when addressing the responsibilities of healthcare providers during these times. There are several legal and ethical issues facing nurses while practicing during a disaster. Nurses are delivering care under altered circumstances, the response effort may be in a state where the nurses is not licensed ,and the nurse may not be protected under the current laws. ANA is working with other professional organizations to create laws to protect all medical responders, but currently the issues persist. Below are some examples of these issues.
1. Licensing Health Care Professionals 2.Emergency Powers Acts 3.Negligence and Malpractices 4.Good Samaritan Laws 5.Informed consent 6.Implied consent 7.Duty to report suspected crimes to the police 8.Advanced directives, including durable power of attorney and living wills
