1 Republic Act 9710 An Act Providing for the Magna Carta of Women
a comprehensive women’s human rights law seeks to eliminate discrimination against women by recognizing , protecting , fulfilling and promoting the rights of Filipino women, especially those in the marginalized sectors 2 What is the Magna Carta of Women?
3 any gender-based distinction, exclusion, or restriction which has the effect or purpose of impairing or nullifying the recognition, enjoyment, or exercise by women, irrespective of their marital status, on a basis of equality of men and women, of human rights and fundamental freedoms What is discrimination against women?
4 “ All individuals are equal as human beings by the virtue of the inherent dignity of each human person. No one, therefore, should suffer discrimination on the basis of ethnicity, gender, age, language, sexual orientation, race, color, religion, political, or other option, national, social, or geographical origin, disability, property, birth, or other status as established by human rights standards”. (MCW, Sec. 3)
5 All rights in the Philippine Constitution and those rights recognized under international instruments duly signed and ratified by the Philippines, in consonance with Philippine laws shall be rights of women under the Magna Carta of Women . These rights shall be enjoyed without discrimination since the law prohibits discrimination against women , whether done by public and private entities or invididuals . What are the rights of women guaranteed under the Magna Carta of Women?
6 Protection from all forms of violence, including those committed by the State This includes the incremental increase in the recruitment and training of women in government services that cater to women victims of gender-related offenses. It also ensures mandatory training on human rights and gender sensitivity to all government personnel involved in the protection and defense of women against gender-based violence and; The Magna Carta of Women spells out the following rights:
7 Protection from all forms of violence, including those committed by the State Mandates local government units to establish a Violence Against Women Desk in every barangay to address violence against women cases.
Covers ALL phases of relief, recovery, rehabilitation and reconstruction efforts , including protection from sexual exploitation. 8 Protection and security in times of disasters, calamities, and other crisis situations
9 Participation and representation Empowerment within the Civil Service - 50/50 gender balance for employees at the 3 rd level position - at least 40% membership in all development councils shall be composed of women Integration of Women in Political Parties - Provide incentives to political parties with women's agenda Leadership in Private Sector - Take measures to encourage women leadership in the private sector in the form of incentives.
Requires review and, if necessary, amendment or repeal of discriminatory laws within three (3) years from the effectivity of the MCW LGUs with the participation of women’s groups shall review existing ordinances and policies and repeal or amend them accordingly. 10 Equal treatment before the law
11 Equal access and elimination of discrimination in education, scholarships, and training Use gender-fair language and revision of gender stereotypes and images in educational materials and curricula Development and use of gender-sensitive curricula and instructional materials
12 Outlawing the expulsion and non-readmission of women faculty due to pregnancy outside of marriage Prohibiting schools from expelling or refusing admission to a female student solely on the account of her having contracted pregnancy outside of marriage during her term in school.
13 Remove gender-based discrimination in competitive and non-competitive sports All government agencies and LGUs are enjoined to increase women’s participation by forming women’s and girls’ teams in various sporting events that they organize or sponsor. Equal participation in sports
Same promotional privileges and opportunities - pay increases - additional benefits - awards Same capacity to act in and enter into contracts , including marriage Leave entitlements such as maternity leave 14 Non-discrimination in the field of military, police and other similar services
15 Non-discriminatory and non-derogatory portrayal of women in media and film Raise the consciousness of the general public… through the strategic use of mass media Formulate policies and guidelines Gender Equality Guide Code of Ethics for Media Guidelines to Protect Women from the Discrimination in Media and Films
Covers ALL stages of a woman’s life cycle Addresses the major causes of morbidity - maternal care - responsible, ethical, legal, safe and effective methods of family planning - encouraging healthy lifestyle activities to prevent diseases 16 Comprehensive health services and health information and education
2 months with full pay based on gross monthly compensation, for women employees who undergo surgery caused by gynecological disorders Rendered 6 months continuous employment service for the last 12 months prior to surgery If extended leave is needed, earned credits may be used. Non-cumulative and non-convertible to cash 17 Special Leave Benefits due to gynecological disorders
Enter into and leave marriages Freely choose a spouse Decide on the number and spacing of their children Enjoy same personal rights - choice of profession - own, acquire, and administer their property Acquire, change or retain their nationality 18 Equal rights in all matters relating to marriage and family relations
19 Food security and resources for food production - equal rights in the titling of the land and issuance of stewardship contracts and patents. Localized , accessible, secure , and affordable housing - consultation and involvement of women in community planning and development The Magna Carta of Women also guarantees the following civil, political and economic rights of women in the marginalized sectors:
20 Decent work standards - creation of jobs in acceptable conditions of freedom , equality , security , and human dignity . Employment , livelihood , credit , capital and technology Skills training - for women migrant and returning migrant workers , and equal opportunity in scholarship especially in research and development , aimed towards women friendly farm technoloy .
21 Representation and participation - in policy - making or decision-making bodies in the regional , national, and international levels . Access to information - regarding policies on women , including development and making available information, education , and communication (IEC) materials on specific programs, services, and funding outlays that affect women . Social protection - to reduce poverty and vulnerability to risks and enhance the social status and rights of all women .
22 Recognition and preservation of cutural identity and integrity - provided that these cultural systems and practices are not discriminatory to women . Inclusion in discussion on peace and development Services and interventions for Women in Especially Difficult Circumstances or WEDC
23 Protection of Girl- Children - against all forms of discrimination in education , health and nutrition, and skills development . Protection of Senior Citizens - from gender-based violence and suspected cases of abuse and neglect
