Marine Insurance A marine insurance policy is a contract of indemnity whereby the insurer undertaken to indemnity the insured against the marine losses according to policy conditions. 9/2/2019 1

Types of Marine insurance Policy Types of Marine insurance Policy: There are different types of policies are used in marine insurance. They are: 1. Voyage Policies: The policy is issued to cover a particular voyage from one port to another and from one place to another The policy mentions the port of departure and the port of destination between which the risks are generally undertaken. For example- London to Chittagong Time Policies: Under this policy, the subject matter is insured for a definite period of time. For example- 1st January 2002 to 1st January 2003. This policy is generally taken for one year although it may be for less than one year. Mixed Policies: In this policy, the elements of voyage policy and of time policy are combined under this policy. Types of Marine insurance Policy Floating Policies: This policy is taken for a round lump-sum which is attached to each shipment with each declaration the amount will be reduced till it is exhausted. When the insured sum is said to be “Closed” and policy is fully declared or runoff. Blanket Policies: The policy is taken to cover losses within the particular time and place, if the actual coverage of risk is less than the total amount of insurance. The premium related to the excess amount is returned to the insured.On the other hand, if the amounts of shipments are greater than the insured sum, additional premium is charged over excess protection. 9/2/2019 3

Types of Marine insurance Policy Valued Policy: Under this policy, the value of loss to be compensated is fixed. The value of the subject-matter is agreed between the insurer and the insured at the time of taking the insurance. The insured value is not necessarily the actual value. Unvalued Policy: When the value of policy is not determined at the time of commencement of risk, then it is called the insurable value or unvalued or valuable policy. 9/2/2019 4

Types of Marine Insurance 1. Hull Insurance: Insurance of vessels and its equipments are included under hull insurance. There are a number of classifications of vessels such as ocean steamers, sailing vessels, builders, and so on. 2. Cargo Insurance: It may be written under a single risk policy or floating policies. The cargo may be of any description, for example, wares, merchandise, property, goods and so on. 9/2/2019 6

Types of Marine Insurance 3. Freight Insurance: Freight is to be payable for the carriage of cargoes. The carrier is unable to earn freight if the goods or property are not safely transported.   4. Marine Perils 1.  Perils of Sea:   Under perils of sea, ordinary action of the winds and waves, ordinary wear and tear to the vessel, inherent risk of the cargo is not included. 2.  Fire: In olden times fire was the biggest maritime perils, but recently it has been under control to a greater extent. Damage resulting from fire and smoke is included under fire-peril. The water is used from extinguishing fire may cause damage to the insured goods. So, this peril is also insurable. 9/2/2019 10

Marine Perils 3.  Man-of-War: This is the vessel which is authorized by nations for the purpose of defense or attack in the event of hostilities. Any damage to the goods or ships arising out of collision against a man of war is insurable. 4.  Enemies: The ships belong to the enemy may cause loss to the insured and is re-underwritten by the marine policy. This policy extends to all the persons of the enemy country and to their hostile act provided such acts from part of the enemy actions. 9/2/2019 11

General Average Loss vs Particular Average Loss General Average Loss Particular Average Loss General average loss is incurred for the benefits of all interest. On the other hand, particular average loss is in connection with any of the interest. General average loss is always voluntary and intentional. The particular average loss is an accidental or fortuitous. General average loss is shared by all those who are benefited by the general average loss. Whereas particular average loss is paid by the insurer. General average loss may include expenditure and sacrifice along with loss. Whereas the particular results from a loss or damage. 9/2/2019 14

Differences bet. the Marine and Fire ins. 1. A Maine insurance policy covers risks arising from a Marine adventure. A Fire insurance Covers risk of fire on properties. 2. Maine insurance is done for a fixed period of time or for a fixed voyage. Fire insurance is usually done for a one year only. 3. In Fire insurance details of the subject mater have to given (usually by answering a set of a printed question). This is generally not required in marine insurance. 4. A Maine insurance policy may be obtained without disclosing the name of the ship (For example-Floating policy). But In Fire insurance, the subject matter of the risk has to be disclosed. 9/2/2019 15
