Objective of MTP Act To provide for the termination of certain pregnancies by Registered Medical Practitioners and matters connected therewith
Definitions Guardian : A person having the care of minor or lunatic Minor: As per Indian Majority act, 1875 it to be deemed not to have attend his majority. Lunatic : Mentally ill (having mental disorder) Registered Medial Practitioner (RMP): A medical practitioner who passes any recognized medical qualification in clause (h) of section 2 of Indian Medical Council Act, 1956, whose name has been entered in State medical register
Circumstances under which pregnancy may be Terminated by RMP Continuation of pregnancy is a risk to the life of pregnant woman or it can cause grave injury to her physical and mental health (Up to 12 weeks of gestation with opinion of one RMP) Substantial risk that the child, if born, would be seriously handicapped due to physical or mental abnormalities; (Up to 12 weeks of gestation with opinion of one RMP) Pregnancy caused by rape; (Up to 20 weeks of gestation with opinion of not less than 2 RMP)
Circumstances under which pregnancy may be Terminated by RMP Failure of contraceptive in married woman. (Up to 20 weeks of gestation with opinion of not less than 2 RMP) A woman who is less than of 18 years of age or is lunatic , with written consent of her guardian
Who can Terminate Pregnancy Medical practitioner, registered in State Medical register immediately before commencement of act, should have not less than 3 years experience in practice of gynaecology or obstetrics. A Medical practitioner, registered in State Medical register on or after commencement can terminate pregnancy if; He has completed six months of house surgery in gynaecology.
He has experience at any hospital for not less than 1 year in the practice of obstetrics and gynaecology. He has assisted Registered medical practitioner in 25 cases of medical termination of pregnancy in government approved hospital In case Registered medical practitioner who holds a post graduate degree or diploma in Gynaecology. Who can Terminate Pregnancy
Places where Pregnancy may be terminated A Government hospital A place approved government for the purpose this act. Place should have : Safe and Hygienic conditions Operation table and instruments for surgery Anaesthetic equipment, sterilization equipment. Drugs and parenteral fluids for emergency use.
Requirement of Consent Consent of woman is required If she is less than 18 years or lunatic, consent of guardian is required
Offences and Penalties
Maintenance of Admission Register Head of hospital or owner should maintenance and admission register. Serial number to each admission should be given such as 11/2021 Information related to women should not be disclose to any person
