3. Introduction:
Amedicalabortionisbroughtaboutbytaking
medicationsthatwillendapregnancy,alternativeisthe
surgicalabortionwhichendsapregnancybyemptyingthe
uteruswithspecialinstruments.
Theinductionofabortionmaybelegal&illegal.
Therearemanycountriesintheglobewheretheabortion
isnotyetlegalised.
InIndiatheabortionwaslegalisedby“Medical
TerminationOfPregnancyAct’’1971,&hasbeenenforced
intheApril1972.

4. Definitions:
Guardian:
Apersonhavingcareofminoroflunatic.
Minor:
ApersonwhoundertheprovisionsoftheIndiaMajorityAct
1875,istobedeemednottohaveattainedhismajority.
RegisteredMedicalPractitioner:
Amedicalpractitionerwhopassesanyrecognizedmedical
qualificationasdefinedinclause(h)ofsec.2oftheIndianMedical
CouncilAct,1956,whosenamehasbeenenteredinastate
MedicalRegister&whohassuchexperienceortraingin
gynecology&obstetricsasmybeprescribedbyrulesmadeunder
thisAct.

5. Definitions:
Owner:
Ownerinrelationtoplace,meansanypersonwhoisthe
administeredheadorotherwiseresponsiblefortheworking
ormaintenanceofsuchhospitalorclinic.
Place:
Itisabuildingtent,vehicleorvesselorpartthereofis
usedforestablishmentormaintenancethereinofahospital
orclinicwhichisusedfortheterminationofanypregnancy.

6. Circumstancesunderwhichthepregnanciesmay
beterminatedbytheRMP:
1.RMPmayterminatepregnancywhenitNMT12weeksold&in
goodfaithofMP.
i)Seriousinjurytophysicalofmentalhealthofpregnantwoman
ii)Childtobebornwouldbeseriouslyhandicappeddueto
abnormalities.
2.RMPmayterminatepregnancymorethan12weeksbutNMT20
weeks,NLT2RMPhassameopinionasmentionedinfirstpoint,
pregnancyisallegedbypregnantwomen:
i)causedbyrape,ii)failureofcontraceptives.

7. 3.RMPmayterminatepregnancyofawomanof18years
ofagewithwrittenconsent.
4.RMPmayterminatepregnancyofawomanofless
than18yearsofageonwrittenconsentofher
guardians.

8. Experience or training:
a.MPregisteredinthestatemedicalregister&haveNLT3
yearsexperienceinpracticeofgynecology&obstetrics.
b.MPregisteredinthestatemedicalregisteronorafter
thedateofcommencementcanterminatepregnancy.
i.Ifhehascompleted6monthofhousesurgencyin
gynecology&obstetrics.
ii.IfhehasexperienceatanyhospitalforaperiodofNLT1
yearpracticeingynecology&obstetrics.

9. iii.IfhehasassistedRMPintheperformanceof25
casesofMTPinhospitalestablishedormaintained
ortraininginstituteapprovedbygovt.
c.RMPwhoholdsPGdegreeordiplomaingynecology
&obstetricsexperienceortrainingduringcourse
isconsidered.

10. Place where pregnancy
may be terminated:
A Government hospital
A place approved for
purpose of this Act.

11. Placeapprovedforterminationofpregnancy:
1.Safe&hygienicconditions
2.Followingfacilitiesarerequired
i.Operationtable&instrumentforperformingabdominal
&gynecologicalsurgery.
ii.Anestheticequipment,resuscitationequipment&
sterilizationequipment.
iii.Drugs&parenteralfluidsforemergencyuse.

12. Inspectionofplaceapprovedforterminationof
pregnancy:
MaybeinspectedbyChiefMedicalOfficer(CMO)of
thedistrict
SatisfactionofCMOofSafety&hygienicconditionof
placeconcerned.
CMOmaycallanyinformationormayseizeany
article,medicine,ampoule,admissionregisteroranyother
document,maintained,keptorfoundatplace.

13. Cancellationorsuspensionofcertificateof
approval:
ChiefMedicalOfficer(CMO)ofthedistrictisnot
satisfiedwiththefacilitiesprovidedundertherules,makea
reportsoffactswithdetailsofdeficienciesordefectsfound
atplacetogovt.
onreceiptofsuchreportgovt.mayeithercancel
thecertificateofapprovalorsuspendthesameasaperiod
hethinkfit.
owneroftheplaceshallbegivenreasonable
opportunityofbeingheard.

14. Maintenanceofadmissionregister:
1)MTPrules1975providesforthemaintenance&admissionof
register.
2)Theheadofhospitalorownerofapprovedplaceshould
maintainregisterinprescribedformofadmissionsofwoman
fortheterminationoftheirpregnancies.
3)Serialnumberisgiventoeachentryofregister.
4)Afreshserialisgiventoeachcalendaryear&distinguished
fromotheryearsserialnumber.
5)Theadmissionregisterissecretdocument,detailsregarding
name&otherparticularsofpregnantwomanshouldnotbe
disclosedtoanyperson.

15. Offences&penalties:
1.TerminationofpregnancybyapersonwhoisnotRMP
shallbeanoffence&punishableunderIndianPinal
Code.
2.Anypersonwhowilfullycontrivancesorfailstocomply
withtherequirementsofanyregulationsmadebystate
govt.ispunishablewithfineupto1000rupees.
3.Nosuitorotherlegalproceedingsshalllieagainstany
RMPforanydamagecausedorlikelytobecausedby
anythingwhichisingoodfaithdoneorintendedtobe
doneunderthisact.
