Sub :- Reservation for OBCs in appointment to the services and posts
under the Government of India – Issue of certificate to the
eligible candidates – clarification – reg.

Government of India, Department of Personnel and
Training.

In Office Memorandum No. 26012/22/93/Estt. (SCT) dated 8/9/93
Government of India have, interdia, issued guidelines for the exclusion-of the
socially, Advanced Persons and sections (Creamy layer) among the OBCs for the
purview of reservation for appointment in Central Government Services. The said
quidelines are based on social and economic criteria and have been listed as
categories Govt to whom the rules of exclusion will apply.

2. As per the circular memorandum second cited, the Revenue authorities in the
State, specified therein, were instructed to verify and issue certificate
in the prescribed format, to the candidates applying for the certificate in the
model form regarding his/her OBC status as well as exclusion from the creamy
layer. If he is found eligible as per the guidelines issued by the Government
of India. Only when a person is found to be in the creamy layer be cannot be
eligible for the certificate for reservation in central services.

3. Some doubts were raised from some quarters regarding the application
of the quidelines issued by the Government of India for the identification of the
‘creamy layer’ income especially with regard to salary and agricultural/criteria.
The matter was, therefore, referred to the Government of India for clarification on
the following points:-

(i) Whether the salary income and /or the income from agricultureal land
shall be reckoned while computing the annual income in any case or in the case
of any category.

(ii) Whether persons in categories I, II and III who are entitled to the
benefit of reservation but having agricultural land and also having income from
other sources, shall be disentitled to the benefit of reservation only fit if the land
holding exceeds the ceiling limit fixed (i.e. without taking agricultural income
into account) or his income from other sources (which will not include salary
income) exceeds the limit fixed under categori VI (a).

(iii) Whether in the case of any persons, otherwise eligible for
reservation under categories VA & VE, salary income, if any, need be recknoed.

4. The Government of India have now clarified that while computing
Annual income under category VI, the income from salary (under categories I, II
or III) and / or income from land (category VA and / or VD (II) shall not be
included. However if a person is disentitled under any one or more of the
categories, disentitlement shall occur notwithstanding eligiblity under any of the
categories. It has also been clarified that Income/wealth tost is not applicable in
the case of Class III and Class IV officers who have no source of income
otherthan salary.

5. The above denotification from Government of India will mean that in
order to be eligible for reservation (exclusion from (Creamy layer) a person will
have to satisfy the entitlement for the benefit under each category. In such a test,
the income from salary and/or income from agricultural holdings shall not be
included for any category other than category V B (i) (ie.) Coffee, Tea or Rubber
(Plantations etc).

It has come to the notice of Government that the Caste/Community Certificates issued
by the Tahsildars are not in conformity with the list of Caste/Community published in Government
of India Gazette Extra Ordinary dated 10.09.1993 and that this results in the loss of the benefits of
reservation to the eligible candidates for appointment to posts/admission in Higher Educational
Institutions under Government of India. The National Commission for Backward Classes has also
observed that the certificate issuing authority is expected to mention the name of the
Caste/Community Certificate strictly as shown in the Central List.
In the circumstances, all the officers who are competent to issue Caste/Community
Certificate are hereby directed to issue Caste/Community Certificates in eligible cases clearly
mentioning the caste as actually shown in the entry in the Government of India Gazette Extra
Ordinary dated 10

September 1993 for getting the benefit of reservation in appointments/admission
to Higher Educational Institutions under the Government of India.

As per Government Order 2

cited above, Government have issued certain guidlines for
identifying the creamy layer among Other Backward Classes for the purpose of issuing non-creamy
layer certificate for getting reservation in public appointments. In the said Government Orders,
persons in the Backward Communities are classified into Six Categories for determining Creamy
Layer.

2. Out of these, in Category II (Service Category) sons and daughters of Group A/Class I, Group
B/Class II officers of Central and State Government services (Direct Recruits) are excluded from
getting non-creamy layer certificates subject to certain conditions laid down in the scheduled to
Annexure D of the Government Orders (Vide 2
nd &
4
th
cited).

3. The Government of India had issued clarifications regarding the issue of Non-Creamy Layer
Certificate in appointments to the Services and Posts under the Government of India as per the letter
3
rd
cited. Based on the above letter in the reference 3
rd
cited, Government hereby clarify the
following points.

4. It is clarified that the creamy layer status of a candidate is determined on the basis of the
status parents and not on the basis of his own status or income or on the basis of status or income of
his/her spouse. Therefore, while determining the creamy layer status of a person the status or the
income of the candidate himself of his/her spouse shall not be taken into account.

5. The following persons coming under Service Category (Category II) are not treated to be falling in
creamy layer.

(a) Parents either of whom or both of whom are directly recruited Class I Group A
officers and such parent(s) dies/die or suffers/suffer permanent incapacitation
while in service;

(b) Parents both of whom are directly recruited Class II/Group B officers and one of them
dies or suffers permanent incapacitation while in service, and

(c) Parents both of whom are directly recruited Class II/ Group B officers and both of
them die or suffers permanent incapacitation while in service, even though either of
them has had the benefit of employment in any International Organisation like UN,
IMF, World Bank, etc. for a period of not less than 5 yerars before their death or
permanent incapacitation.

6. But if the parents(s) dies/die or suffers/suffer permanent incapacitation in such cases after
retirement from service, his/their sons and daughters would be treated as falling in the creamy layer
and would not get the benefit of reservation.

7. The Sons and daugheters of parents who are included in the creamy layer on the basis of
service status of their parents shall continue to be treated in creamy layer even if their parents have
retired or have dies after retirement.

8. The Sons and daugheters of parents of whom only the father is it directly recruited
Class II/GRoup B officer who gets in to Class I/Group A at the age of 35 or earlier are
treated to be in creamy layer. If the father is directly recruited Class III/Group C or
Class IV/Group D employee and he gets into class I/Group A at the age of 35 or earlier,
his sons and daughter shall not be treated to be falling in creamy layer,

9. Explanation to the clause “Income from Salaries or Agricultureal land shall not be
clubbed’’ given in the Scheduled D of Government Order in the 2
nd
and 4
th
cited, is as
given below.

While applying the Income/Wealth Test to determine Creamy Layer status of any
candidates under Category VI, income from salaries and income from agricultural
land shall not be taken into account. It means that if income from salaries of the parents
of any candidates is more than Rs.4.5 lakhs per anum, income from agricultural land is
more than 4.5 lakhs per annum, but income from other sources is less than Rs. 4.5 lakhs per
annum, the candidates shall not be treated as falling in the Creamy Layer on the
basis of Income / Wealth Test. Provided his/her parents do not process wealth above
the exemption limit as prescribed in the Wealth Tax Act for a period of three consecutive years.

The exemption limit under the wealth Tax Act, 1957 was Rs. 15 lakhs for the Financial Year till
31.3.2009 and has been raised to Rs.30 lakhs with effect from 01.04.2009.

10. The assets liable to wealth tax under the Wealth Tax Act are the following.
 Any building or land which includes commercial buildings, residential buildings, any guest
house, a farm house situated within 25 kilometers from the local limits of any
municipality.
 Motor Cars
 Jewellery that included ornaments, made of gold, silver, platinum or any other precious
metal of any alloy containing one or more of such precious metals as well as precious or
semi precious stones.
 Bullion, furniture, utensils or any other articles made wholly or party of gold, silver,
platinum or any other precious metal
 Yachts, boats and aircrafts.
 Urban land
 Cash in hand

11. The criteria prescribed for determining creamy layer status of sons daughters of
persons in Government service mutatis mutandis applies to the sons and daughters
of persons holding eauivalent or comparable posts in PSUs. Banks, Insurance
Organisations, Universities etc. and also holding equivalent or comparable posts and
positions under private employment. The creamy layer status of the sons and daughters of
employees of organisations where evalution of the posts on equivalent or comparable basis
has not been made is determined on the basis of ‘Income/Wealth Test’ givenin the Schedule.
The Income/Wealth Test prescribes that the sons and daughters of persons having gross
annual income of Rs.4.5 lakh or above or possessing wealth above the exemption limit
as prescribed in the Wealth Tax Act for a period of three consecutive years would be treated
to fall in Creamy Layer.

12. It is clarified that the creamy layer status of sons and daughters of persons
employed in organisations where equivalence or comparability of posts vis-a-vis
posts in Government has not been evaluated is determined as follows.

Income of the parents from the salaries and from the other sources [other than salaries
and agricultural land] is determined separately” If either the income of the parents from the
salaries or the income of the parents from other sources [other than salaries and
agricultural land] exceeds the limit of Rs.4.5 lakh per annum for a period of three
consecutive years, the sons and daughters of such persons shall be treated to fall in creamy layer.
But the sons and daughters of parents whose income from salaries is less than Rs.4.5 lakh
per annum and income from other sources is also less than Rs.4.5 lakh perannum will not be treated as

falling in creamy layer even if the sum of the income from salaries and the income from other sources
is more than Rs. 4.5 lakh per annum for a period of the consecutive years. It may be noted that
income from agricultural land is not taken into account while applying the Test.

13. The list of OBCs as per the KS &SSRs will be valid list as OBCs entitled to get creamy
layer/non-creamy layer certificates.

Verification/Acceptance of Caste Certificate furnished by Candidates
claiming to belong to OBC
[Para 21,10]

The undersigned is directed to refer to Dept.of Per. & Trg’s O.M.No.36012/6/88-
Estt.(SCT), dated 24.4.1990, on the subject mentioned above wherein it was indicated that
the appointing authority should include a clause in the offer of appointment to the
candidates belonging to SC/ST to the effect that the appointment was provisional and
would be terminated in case the caste certificate produced by them was found to be
false.
2. After the issue of reservation orders of OBCs, it is considered necessary to have
similarly provisions in respect of the case certificate furnished by candidates claiming to
belong to OBC communities.
3. In the offer of appointment to candidates claiming to belong to OBC, the
appointing authority should include a clause as follows:-
“The appointment is provisional and is subject to the caste certificate being
verified through the proper channels. If the verification reveals that the claim of
the candidates to belong to OBC is false, the services of such candidates will be
terminated forthwith without assigning any further reasons and without prejudice
to such further action as may be taken under the provisions of the Indian Penal
Code for production of false certificate.’’
4. All Ministries/Departments are requested to take further action on the
above lines.

Validity Period of OBC Certificate and Verification of Community and
‘Non-Creamy Layer’ status of OBC Candidates

The undersigned is directed to say that a question has arisen about the validity period
of certificates issued to the candidates belonging to other backward classes for the purpose
of reservation in services. The OBC certificate consists of two parts – first part indicates
that the concerned person belongs to a community listed as OBC and the second part
indicates that the candidate does not fall in the creamy layer. While the OBC status of a
candidate may change only when the community of the concerned candidate is
removed from the OBC list, his/her creamy layer status may change any time. Inview
of it, it is not possible to determine a fixed validity period for the OBC certificate.

2. Every candidate seeking reservation as OBC is required to submit a certificate
regarding his/her ‘OBC status and non-creamy layer status issued by an authority
mentioned in DOP & T Office Memorandum No. 36012/22/93 Estt,(SCT), dated
15.11.1993. The ‘OBC status’ and /or ‘non-creamy layer status’ of the candidate, as
pointed out in para above, may change after issue of the certificate making him/her
ineligible for reservation. In order to ensure that candidates not eligible to get reservation
do not seek reservation, a declaration, in addition to certificate issued by the Competent
Authority, may be obtained from the candidates seeking reservation as OBCs in the
following format:
“I,.....................................................son/daughter of Shri.............................
resident of village/town/city............................. district................................
state.....................................hereby declare that I belong to the...................
Community which is recognized as a backward class by the Government of India
for the purpose of reservation in service as per orders contained in Department of
Personnel and Training Offic Memorandum No. 36012/22/93-Estt.(SCT), dated
8.9.1993. It is also declared that I do not belong to persons/Section (Creamy
Layer) mentioned in column 3 of the schedule to the above referred Office
Memorandum, dated 8.9.1993.’’
3. The appointing Authority, before appointing a person seeking appointment on the
basis of reservation to OBC should verify the veracity of the community certificate
submitted by the candidate and also the fact that he/she does not fall in creamy layer on the
crucial date. The crucial date for this purpose may be treated as the closing date for receipt
of application for the post except in case where crucial date is fixed otherwise.
4. It was decided vide this Department’s Office Memorandum No.36033/9/95-
Estt.(SCT), dated 10.5.1995 that in case of appointments against vacancies reserved for
OBCs, a clause in the offer of appointment would be inserted to the effect that
appointment will be provisional and subject to verification of the community certificate.
Since reservation is available only to such OBC candidates who do not fall in the creamy
layer, it is necessary that the clause inserted in the offer of appointment should be modified
so as to take care of creamy layer status of the candidate also. It is, therefore, decided that
the following modified clause may be included in the offer of appointment in place of
clause prescribed vide Office Memorandum, dated 10.5.1995:

“The appointment is provisional and is subject to the community certificate
being verified through the proper channels. If the verification reveals that the
claim of the candidate to belong to Other Backward Classes or not to belong to
creamy layer is false, his/her services will be terminated forthwith without
assigning any further reasons and without prejudice to such further action as
may be taken under the provisions of Indian Penal Code for Production of false
certificate.”

5. All Ministries/Departments are requested to bring the contents of this Office
Memorandum to the notice of all authorities under them for information and compliance.

ORDER

As per Government Order 2
nd
cited, the State Government have entrusted the Kerala
State Commission for Backward Classes, to conduct an independent Ashoka Kumar Thakur case
[(2008) 6 SCC 1] and to submit a report for evolving a scheme for excluding the creamy layer from
the Backward Classes for reservation in admission to Professtional Degree Courses under Article
15(4) of the Constitution of India taking into consideration the socio-economic and educational
background of different communities, including the income derived by the family as directed by the
Hon’ble High Court in the common judgment dated 07.08.2013 in W.P.(C) Nos. 29271/12 and
11578/13.
2. The Kerala State Commission for Backward Classes, accordingly conducted the
study, and submitted a report vide letter read as 5
th
paper above.
3. Government have examined the matter in detail and considered the report and
accept the recommendations and guidlenes for excluding the creamy layer among SEBCs for the
purpose of reservation of seats in admission to Professional degree courses in Kerala as per the terms
of reference and orders as follows:
(i) Annual income of Rs. 6 lakhs or above or possession of wealth above the
exemption limit as prescribed in the Wealth Tax Act for a period of three
consecutive years, is fixed as the criteria for determining the creamy layer.
(ii) The guidelines and criteria to be adopted for identifying the creamy layer among
SEBCs made by the KSCBC are accepted and shall be observed.
(iii) The Creamy Layer criteria applied to SEBCs shall be applied to OECs and
children of interacts married couples as well.
4. The guidelines for excluding the creamy layer among SEBCs mentioned in para
3(ii) above are given in Annexure I to this Order.

5. The list of SEBCs in Kerala for whom Creamy Layer assessme applicable is
shown in Annexure ‘II’.
6. The schedule showing the description of categories of people to whom the rule of
exclusion will apply is appended as Annexure ‘III’.
7. The Form of application for the issue of certificate will be as shown in Annexure IV.
8. The form of Certificate to be issued will be as shown in Annexure V.
9. The authority to issue the certificate to candidates who do not belong to the Creamy
Layer among SEBCs will be any of the following officers:-
(a) District Magistrate/Additioal District Magistrate/Collector/ I Class Stipendiary
Magistrate/Sub Divisional Magistrate/Taluk Magistrate/Executive Magistrate/Sub
Divisional Magistrate).
(b) Chief Presidency Magistrate / Additional Chief Presidency Magistrate/ Presidency
Magistrate.
(c) Revenue Officer not below the rank of Tahasildar and
(d) Sub Divisional Officer of the area where the candidates and / or his family normally
resides.
10. The Creamy Layer Certificate should be issued or refused, as the case may be within
7 days of the receipt of the application for such certificate.
11. These orders will apply to all educational institutions owned/controlled by the State
Government other than the Institutions governed by minority communities under Article 30(1) of
the Constitution of India.
12. It is clarified that for the purpose of claiming reservation of seats in professional
degree courses, the Government Order read as 4

will stand.

ANNEXURE I

THE GUIDELINES FOR EXCLUDING THE CREAMY LAYER AMONG
THE SOCIALLY AND EDUCATIONALLY BACKWARD CLASSES
(SEBCs) IN THE STATE OF KERALA FOR THE PURPOSE OF
ARTICLE 15(4)

1. These guidelines may be called “the scheme for excluding the creamy layer
among the SEBCs in the State of Kerala”.

2. These guidelines shall come into force with effect from the academic year
2015-16 includible in the KEAM 2015 Prospectus for Professional Degree
Courses.

3. The list of 86 castes/communities including their sub-castes under six heads
specified in Annexure - XI KEAM Prospectus for the academic year 2014-15,
until a revised list of SEBCs is prepared after proper study will be the list of
SEBCs for whom the Creamy layer guideline would apply. Annexure A.

The creamy layer criteria fixed for the purpose of Article 16(4) in Annexure-D
SCHEDULED to G.O.(P)No.81/09/SCSTDD dated 26

September, 2009
(Appendix V), the income limit as modified from time to time and the
clarification to the G.O. dated 26.09.2009 issued by the State Government in
Circular No.27396/F3/07/SCSTDD dated 14.06.2010 is recommended for
adopting and applying for exclusion of socially advanced persons/
sections(creamy layer) among the SEBC communities for the purpose of
reservation in admission to Professional Degree Courses under Article 15 (4)
also with the following modifications. In Annexure-D SCHEDULE, in
column 3 – To whom rule of exclusion will apply - under Category II –
Service Category – against B – Group – B/Class II Officers –in (d)
and (e) for the words in the brackets “direct recruit or pre thirty five promoted”

the following words, namely, direct recruit or pre thirty six promoted”
in brackets shall be substituted.

Note: This modification is suggested in view of the enhancement of
the age of retirement of State Government employees from 55 to 56 as
on this date.

4. RS.6 lakh or above is fixed as the gross annual income limit for
determining the creamy layer among the SEBCs or possessing
wealth above the exemption limit as prescribed in the Wealth Tax Act
for a period of three consecutive years.

Note: while determining the creamy layer status of any applicant
for the purpose of obtaining reservation benefits Contemplated under
Article 15(4) by applying the income/ wealth Test under category VI
in Annexure D of the Government order dated: 26.09.2009 (Which
at present is applicable for the purpose of reservation under article
16(4) only) can be adopted and followed. The KSCBC, in fixing the
income limit at Rs. 6 lakh for the purpose of Article 15(4) took into
account the exclusion of income from salaries and income from
agricultural land in computing the gross annual income. It means that
even if income from salaries or income from agriculture land of the
parents of any candidate, either separately or taken together, exceeds the
income limit fixed under category VI unless there is Other Income
which is more than the income limit fixed under category VI he/she
does not become a ‘Creamy layer’ ineligible for the reservation
benefits under Article 15(4). In other words what is reckoned
for the computation of gross annual income limit for such
persons is the income from ‘Other Sources” only and not any
other income. Similarly, the candidate shall not be treated as creamy layer

provided his/her parents do not possess wealth above the
exemption limit as prescribed in the Wealth Tax Act for a period
of three consecutive years. In effect, in the case of applicants
whose parents having income from salary or income from
agriculture land when the income considered for fixing the
income limit of Rs. 6 lakh it is as good as fixing a substantial
amount. This will be sufficient for giving Professional education
to their children at least two in number in a reasonable way. Hence
adoption of the method of computation of income under the
Income/Wealth Test under Category VI of the Schedule to the
Government Order dated 26.09.2009 for the purpose of Article 15 (4) is
an absolute necessity.

5. The criteria for exclusion for creamy layer for reservation to
SEBCs in admission to Professional Degree Courses mentioned
in the KEAM Prospectus is given in the Scheduled attached hereto.
The GO(P) NO.208/66/Edn dated 02.05.1966 dealt with under
para 4 under Recommendation No. 1 providing for income criteria
will stand modified as above.

6. The clarification to the Government order dated 26.09.2009
issued by the State Government in circular No. 27396/F3/07/SCSTDD
dated 14.06.2010 (Appendix V(A)) shall be applied for issue of
Non-creamy layer certificate to the eligible SEBCs.

7. The Creamy layer criteria applied to SEBCs shall be applied to
OECs as well in the matter of reservation in admission under
Article 15(4).

8. AT present sons or daughters of inter caste married couple need not
produce the income certificate for claiming SEBC reservation. In other
words they are excluded from the income limit fixed in the G.O. dated
02.05.1966. Since the eligibility criteria based solely on income is given
a go by and the new creamy layer criteria is introduced for exclusion of
socially advanced persons/sections in the SEBC communities the
Government Orders issued in their favour cannot stand. AS such the
KSCBC do not find any reason at present to exclude them from the
application of the new creamy layer criteria including the income/Wealth
Test.

9. The form of application for the issue of certificate is shown in
Annexure II.

10. Form of certificate to be produced by SEBCs for admission to
Professional Degree Courses is shown in Annexure III.

11. The Authority to issue the certificate to candidates who do not belong to
the creamy layer will be any one of the following officers:

a) District Magistrate/Additional District Magistrate/Collector/
I Class Stipendiary Magistrate/Sub Divisional Magistrate/
Taluk Magistrate/Executive Magistrate/ Extra Assistant
Commissioner (not below the rank of I Class Stipendiary
Magistrate)

b) Chief Presidency Magistrate/Additional Chief Presidency
Magistrate/Presidency Magistrate

c) Revenue Officer not below the rank of Tahsildar and
d) Sub Divisional Officer of the area where the candidates and
or his family normally resides.

Creamy layer certificate applied for should be issued or refused,
as the case may be within 7 days of the receipt of the application.
