Objective and Applicability 1. Background: The 'Machinery and Electrical Equipment Safety ( Omni bus technical regulations - OTR ) Order, 2024' was released on 28th August 2024. It will become compulsory from 2 7 th Aug. 2025 , after a one-year grace period . 2. Objective of the Regulation: Ensure the safety and reliability of machinery and electrical equipment used in industries. Standardize compliance requirements to enhance workplace safety. Prevent hazards associated with substandard components .

Applicability: This order is applicable for Indian markets. The order applies to machines and electrical equipment and their assemblies, sub-assemblies and components listed in 3 Schedules that are annexed to the order (separate PDF). For Yuken : HPU and their subassemblies, components. Components :Pumps, Valves, motors, cylinders, filters, solenoids, Etc., Compulsory Applicable for all import parts/products Importance of Adherence Mandatory for market compliance by Aug 2025. Standard Structure and Essential Requirements The various IS standards that are applicable to the different type of equipment are basically classified into 3 types : Type “A” standard (Also known as schedule 1) – General principles for design safety & risk assessment of machinery & electrical equipment Type “B” standard  (Also known as schedule 2) – Generic Safety standards (one or multiple) dealing with one safety aspect or more than one type of safeguard that can be used across a wide range of machinery . Type “C” Standard (Also known as schedule 3) – Machine Safety Standards dealing with detailed safety requirements for a particular machine or group of machines

Standard Structure and Essential Requirements FOR Type “A” Applicable IS standard. IS 16819:2018/ISO 12100:2010 (Safety of Machinery General Principles for Design- Risk Assessment and Risk Reduction. For Type “B” & “C” Applicable IS Standards.: A s per the second & Third schedules mentioned in separate table. (refer attached Std. PDF) Each product or machine must be verified against the applicable standards based on its HS code , as specified in the Schedule List. Labeling and Marking Requirements : Scheme X of the Conformity Assessment Regulations. Technical File Requirements : Compliance with Scheme X .

Certification Process Process Steps Application submission. Desk evaluation of technical files. Inspection and evaluation. Evidence submission and conformance. Certification Types License for Continuous Production (3-6 years). Certificate of Conformity (CoC) for One-Time Production. Certification required for each manufacturing location.

Registration Requirements Manufacturing companies must register with BIS for each location if they have multiple locations. Companies must get approval for their machinery or electrical equipment before placing it on the market. Foreign companies must submit hard copy registration as the portal is currently not open for them. Companies must have a legal local representative who is a resident of India. Other certifications (e.g., CE, JIS, UL) are not considered valid for compliance with OTR, 2024. Required Information Name, address, PAN, GST, contact details, and legal entity information. Fee Structure Application fee for licence /CoC - ₹ 2,000 Certification fee for licence to use BIS Standard Mark - ₹ 25,000 / year Certification fee for CoC - ₹ 10,000 Fee for review of technical file - ₹ 20,000 / technical file Inspection fees - ₹ 20,000 / manday Sample procurement and testing fees - On actuals Concession of 20% to MSMEs - Except in application fee and those on actuals Enhanced concession till 31 May 2026 Micro scale - 80%, Start-up units - 80%, Small scale - 50 % Women MSMEs - Additional 10% concession Units in North-East areas - Additional 10% concession

Exemptions Goods for Export: Order does not apply to domestically manufactured goods for export. Construction Equipment: Exemption under CMVR Rule 1989 issued by MoRTH .

Challenges Identified Challenges Identified / Ambiguities in Certification Process : Lack of clarity on certain aspects like grouping of products which is having same function but smaller changes in dimensions. details on Imports - were parent company buy the parts as a bought out. Decision on getting Coc or Certificate for rare orders (like once in 4 years). BIS is still integrating queries where sufficient information is unavailable.

IMPLEMENTAION Steps Conduct internal gap analysis for compliance with applicable IS standards. Verify applicable standards using HS codes for each product or machine. Register all business locations immediately to initiate the certification process.

Conclusion Key Summary : OTR, 2024 ensures safety and regulatory compliance for machinery and electrical equipment. Verification of applicable standards per HS codes is mandatory. Registration with BIS is critical and time-sensitive Start registration immediately.
