Introduction Panchayati Raj is the oldest system of local government in the Indian subcontinent First panchayati raj system is in Nagpur city rajasthan (1959) Father of panchayati raj --- Balwant rai . Bill introduced in sep 1990 ( Narasimba rao government) Amendment bill lok sabha sep 1991 Bill passed emerged as the 73 rd constitutional amendment act 1992

Significance of panchayat raj system
Significance of Panchayat raj system The Amendment act provide shape to at article 40 of the constitution (directive principle of the state policy )which direct the state organise the village . The act has two parts 1.Compulsory provision 2. voluntary provision Compulsory provision –added to state law and it include the creation of the panchayati raj system . voluntary provision –the discretion of the state government

section 243 C election of member and chairperson -district level and intermediate level election for the chairperson is INDIRECT -the member to all level of the panchayat raj are elected DIRECT -every state have their different policy /term and condition . SECTION 243 A -it is the primary body of the panchayat raj system . -it is a village assembly consisting of all registered voters within the area of panchayat. SECTION 243 B -THREE tier system 1. _district level _2._intermediate level _3.___village level some village contain only 2 levels
Section 243 D RESERVATION OF SEATS At every level,reservation of seats occur according to population percentage . -for women –not less then one –third of the total number of seats to be reserved for women the state legislative are also given the provision to decide on the reservation of seats in any level of panchayat or office of chairperson in favour of backward classes
243F-DISQUALIFICATION FOR MEMBERSHIP -under any law for the time being in force for the purpose of election to the legislative of the state government -eligibility age -21 year All the question relation to disqualification shal be referred to an authority determined by the state legislative No criminal record 243 E- duration of panchayat -the act provide for a five year term of office to all the level of the panchayat -but fresh election to constitution the new panchayat shall be complete -before the expiry of its five year duration -In the case of the dissolution ,before the expiring of a period of six months from the dates of dissolution.
243GI (POWER ,AUTHORITY AND RESPONSIBILITIES ) -state legislative may endrow the panchayat with such power and authority may be necessary to enable them to function as institution -the preparation of plans for economic developnment -the implementation of scheme for economic social justice 243H (POWER TO IMPROVE TAXES BY AND FUNDS OF THE PANCHAYAT ) - Authorize a panchayat to levy , collect taxes,duties and tolles duties - provide for the constitution of funds for credition all money of the panchayat . -assign to a panchayat taxes,duties
243 I (state finance commission ) State finance commission review the finance position of the panchayat. 243J (audit of accounts) State finance commission may make provision for the maintance and audit of panchayat account 243 K (election of panchayat ) The election rules can vary from state to state Panchayat election are to be conducted and overseen by the state election commission.
243 L (application to union territories ) The president may discret the provision of the act to be applied on any union territories . 243M(part not to apply to certain area ) States –Nagaland , meghalya and Mizoram The scheduled area and the tribal area in the state Parliament can extended this part to these area subject to the exception to the modificiation of the 73 rd amendment act 1992 . 243 N (continues of existing laws and panchayats) All state law relating to panchayat shall continue to be force until the expiring of one year from the commencement of the act . State adapt the new panchayati raj system based on the act with the maximum period of one year from 24 april1993
243 O (bar interference by court) The act bars the court from interfering in the electrol matter of panchayat. If further lay down that no election to any panchayat is to questioned except by an election petition presented to such authority and in such authority and in such a manner as provided by the state legislative .
