Overview of the PCT System The Patent Cooperation Treaty (PCT) is an international patent law treaty of enablement, concluded in 1970 . It has supported by 195 countries, 16 associations some good no.of treaties are available(26) holds large data in meaningful format. It provides a unified procedure for filing patent applications to protect inventions in each of its contracting states . A patent application filed under the PCT is called an international application, or PCT application.
Difference Between Paris Convention and PCT: Firstly , the Paris Convention on Industrial Property Protection governs every invention has international filing right . Parties to the Paris Convention can also form part of the Patent Cooperation Treaty (PCT ). The PCT allows inventors to file an international patent application .
What is the role of WIPO in the PCT WIPO administers the PCT. It also serves as Secretariat to member States bodies such as the PCT Assembly , the PCT Working Group and the Meeting of International Authorities . Further , for each PCT application filed, WIPO is responsible for: Receiving and storing all application documents in CAD database. P erforming a formality examination. P ublishing the international application on WIPO’s online database PATENT SCOPE / CAD_USTP .
Publishing data about the PCT application as prescribed in the Treaty and Regulations. T ranslating various portions of the PCT application and certain associated documents into English and/or French, where necessary. Language translators are available in CAD. Communicating documents to Offices and third parties. Providing legal advice on request to Offices and users to protect the documents securely on the database.
