Introduction The Water (Prevention and Control) Act, 1974 was introduced to prevent and control water pollution and to restore and maintain the wholesomeness of water for the establishment. The act prescribes penalties and procedure of water pollution.

PENALTIES Violating water pollution regulations can result in severe penalties, including fines, legal action, and closure of facilities. It is important to understand the consequences of non-compliance

PENALTIES Of water pollution act 1974 fines Old provision Section 25 of the Act provides for penal provisions, in which the violator of the provisions will be punishable with a jail term of not less than one year and six months that can extend up to six years. New provision The new amended act removes imprisonment as a punishment, and prescribes a penalty between ₹10,000 and ₹15 lakh. Failure to pay penalty for violation of any provision under the Act will attract a jail term of up to three years, or a fine up to twice the amount of penalty imposed.

Reasons for penalties

Contravention of standards : Any person, including industries, discharging pollutants in excess of the prescribed standards, is liable for PENALTIES. Failure to obtain Authorization : Industries and entities discharging pollutants into water bodies without obtaining the necessary Authorization from spcb or cpcb .

Closure of polluting units : The spcb or cpcb has the authority to order the closure of industries Or units that do not follow conditions specified in the Authorization.

Emergency measures : Failure to comply with emergency measures specified by the pcb during situations of Acute pollution can lead to PENALTIES. Offence by companies : If the person responsible for the conduct of the business of a company is found of an offense, both the individual and the company can be penalized. Repeat offenses : Higher penalties may be imposed for repeat offenses .

Procedure

Inspection and sampling: Pcb or authorised officers have the power to enter any premises, inspect and take sample of emissions or other substances for analysis. Service of notices: If pollution control board believes that a person is discharging pollutants in excess of the prescribed standards, it may Serve a notice on the person requiring compliance or specifying corrective measures.

: Authorization for discharge :
Industries and entities discharging pollutants must obtain Authorization from the pollution control board. The Authorization specifies the conditions and standards for discharge. Adjudication : In case of contravention, the pollution control board may initiate adjudication proceedings. Adjudicating officers have the power to determine the liability and impose PENALTIES.

Appeals :
Persons aggrieved by the orders or decisions of the pollution control board or adjudicating officers have the right to appeal to the appellate authority. Enforcement : Pcb have the authority to enforce compliance with the provisions of the act, including the imposition of PENALTIES.

Emergency measures : During situations of Acute pollution or environmental emergencies, the pcb may issue orders specifying emergency measures to be taken by industries or entities. Publication of information : The pcb are required to publish information on water Quality, pollution levels and other relevant data to keep the public informed.

Compensation : The act provides for the payment of compensation by polluters for any damage caused to the environment or to any property as a result of pollution. Cognizance of offenses: Courts can take cognizance of offenses under the act based on complaints or information received from pollution control boards or authorized officers.
