9344, otherwise known as the “Juvenile Justice
and Welfare Act of 2006”, as amended by
Republic Act No. 10630, is further amended to
read as follows:

SEC. 4. DEFINITION OF TERMS
"(s)‘BahayPag-asa’–referstoa24-hourchild-caring
institutionestablished,fundedandmanaged[bylocal
governmentunits(LGUs)]THEDEPARTMENT OF
SOCIAL WELFARE AND DEVELOPMENT
(DSWD)andlicensedand/oraccreditednon-government
organizations(NGOs)providingshort-termresidentialcare

Ihavereservationsonsuchexpandingoftheagebracket
First,itwouldcongestBahayPag-asaandanyotheryouthcare
facilities
Second,theagesfrom9yearsoldto11yearsoldaretometheyare
likebabiesandareoftenderagesandarenotyetadolescents.
TheyarechildrenwhoneedstobeprotectedbytheState(they
shouldbecommittedtothecareoftheirfatherormotheror
relatives).Underexistinglaws,rulesandregulations,the
minimumageforchildrencommittedtoayouthcarefacilityor
“BahayPag-asa‟shallbetwelve(12)yearsold.Thus,9to11
yearsoldchildrenshouldbecommittedtothecareoftheir
parentsorrelatives

INTERVENTION PROGRAM
•refers to a series of activities which are designed
toaddressissuesthatcausedthechildtocommit
anoffense.
•Itmaytaketheformofanindividualized
treatmentprogramwhichmayincludecounseling,
skillstraining,groupactivities,parenting
educationseminarsforparents,education,and
otheractivitiesthatwillenhancehis/her
psychological,emotionalandpsycho-socialwell-
being.

DIVERSION PROGRAM
•Referstotheprogramthatthechildinconflict
withthelawisrequiredtoundergoafterhe/sheis
foundresponsiblefor,offensewithoutresortingto
formalproceedings.
•It prevents the child offenders from entering the
formal criminal justice system
•A typical component of the restorative
approach to justice.

Sec. 3, Section 20 of the same Act, as amended, is
further amended to read as follows:
"SEC.20.ChildrenINCONFLICTWITHTHELAWBelowtheAge
of[Criminal]Responsibility.–Ifithasbeendeterminedthatthechild
takenintocustodyis[fifteen(15)yearsoldor]belowNINE(9)
YEARSOFAGE,theauthoritywhichwillhaveaninitialcontact
withthechild,inconsultationwiththelocalsocialwelfareand
developmentofficer,hasthedutytoimmediatelyreleasethechild
tothecustodyofhis/herparentsorguardian,orintheabsence
thereof,thechild’snearestrelative.Thechildshallbesubjectedtoa
community-basedinterventionprogramsupervisedbythelocal
socialwelfareanddevelopmentofficer,[unlessthebestinterestof
thechild]requiresthereferralofthechildtoayouthcarefacilityor
‘BahayPag-asa’managedbyLGUsorlicensedand/oraccredited
NGOsmonitoredbytheDSWD].

"Thelocalsocialwelfareanddevelopmentofficershall
determinetheappropriateprogramsforthechildwhohas
beenreleased,inconsultationwiththechildandtheperson
havingcustodyoverthechild.THEASSESSMENT
SHALLINCLUDEIDENTIFICATIONOFPHYSICAL
ANDMENTAL HEALTHISSUES,SUBSTANCE
ABUSEANDFAMILYISSUES.Iftheparents,guardians
ornearestrelativescannotbelocated,oriftheyrefuseto

Sec. 5, Section 20-B of the same Act, as amended,
is further amended to read as follows:
"SEC.20-B.RepetitionofOffenses.–Achildwhois[above
twelve(12)yearsofage]NINE(9)yearsofageupto

ageandwhocommitsanoffenseforthesecondtime

Sec. 6, Section 20-C of the same Act, as amended,

Crimes.–Anypersonwho,inthecommissionofa
crime,makesuse,takesadvantageof,orprofits
fromtheuseof[children]ACHILD,includingany
personwhoabuseshis/herauthorityoverthechild
orwho,[withabuseofconfidence,takesadvantage

Section 8.Section 22 of the same Act is hereby
amended to read as follows:
"SEC.22.DutiesDuringInitialInvestigation.–Thelawenforcement
officershall,inhis/herinvestigation,determinewherethecase
involvingthechildinconflictwiththelawshouldbereferred.
"Thetakingofthestatementofthechildshallbeconductedinthe
presenceofthefollowing:(1)child’scounselofchoiceorinthe
absencethereof,alawyerfromthePublicAttorney’sOffice;(2)
thechild’sparents,FOSTERPARENT,guardian,ornearest
relative,asthecasemaybe;and(3)thelocalsocialwelfareand
developmentofficer.Intheabsenceofthechild’sparents,
FOSTERPARENT,guardian,ornearestrelative,andthelocal
socialwelfareanddevelopmentofficer,theinvestigationshallbe
conductedinthepresenceofarepresentativeofanNGO,
religiousgroup,ormemberoftheBCPC.

"TheLOCALsocial[worker]WELFARE AND
DEVELOPMENT OFFICERshallconductaninitial
assessmenttodeterminetheappropriateinterventions
andwhetherthechildactedwithdiscernment,usingthe
discernmentassessmenttoolsdevelopedbytheDSWD.
Theinitialassessmentshallbewithoutprejudicetothe
preparationofamorecomprehensivecasestudy

measuresimposeduponthechildinconflictwiththelawhave
notbeenfulfilled,orifthechildinconflictwiththelawhas
willfullyfailedtocomplywiththeconditionsofhis/her
dispositionorrehabilitationprogram,thechildinconflictwith
thelawshallbebroughtbeforethecourtforexecutionof
judgment.

Ifsaidchildinconflictwiththelawhasreached
eighteen(18)yearsofagewhileundersuspended
sentence,thecourtshalldeterminewhetherto
dischargethechildinaccordancewiththisAct,toorder
executionofsentence,ortoextendthe[suspended]
SUSPENSIONOFTHEsentenceforacertain
specifiedperiodoruntilthechildreachesthemaximum

disciplinaryinterventionprogram.TheJJWCinpartnership
with,butnotlimitedto,theDSWD,theDOH,theDepEDand
theDILG,willdevelopandsetthestandardsforthe
implementationofthemulti-disciplinaryinterventionprogram
oftheIJISC.UponinstitutionalizationoftheIJISCprogram,
theJJWCwillcontinuetomonitorandprovidetechnical

Section 16.Section 64 of the same Act is hereby
amended to read as follows:
SEC.64.ChildreninConflictwiththeLaw[Fifteen(15)Years

ofthisAct,cases[ofchildrenfifteen(15)yearsoldand]
INVOLVINGCHILDRENINCONFLICTWITHTHELAW
belowNINE(9)YEARSOFAGEatthetimeofthecommission
ofthecrimeshallimmediatelybedismissedandthechildshallbe
referredtotheappropriatelocalsocialwelfareanddevelopment
officer.Suchofficer,uponthoroughassessmentofthechild,shall
determinewhethertoreleasethechildtothecustodyofhis/her
parents,orreferthechildtopreventionprogramsasprovided
underthisAct.Thosewithsuspendedsentencesandundergoing
rehabilitationattheyouthrehabilitationcentershalllikewisebe
released,unlessitiscontrarytothebestinterestofthechild.

•Section17.ImplementingRulesandRegulations.–
TheJJWCshallpromulgatethenecessaryrules
andregulationswithinninety(90)daysfromthe
effectivityofthisAct.
•Section18.SeparabilityClause.–Ifanyprovision
ofthisActisheldunconstitutional,other
provisionsnotaffectedtherebyshallremain
validandbinding.

Section19.RepealingClause.–RepublicAct9344,as
amendedbyRepublicAct10630isherebyamended
accordingly.Alllaws,decrees,ordinancesandrules
inconsistentwiththeprovisionsofthisActarehereby
modifiedorrepealedaccordingly.
Section20.EffectivityClause.–ThisActshalltakeeffect
fifteen(15)daysafterthecompletionofitspublication
intheOfficialGazetteorinanewspapersofgeneral
circulation.
