The structure has been vacated by landowner however construction of culvert and other construction activities is not yet allowed by landowner. PMU has requested DC, Kohima for resolving the matter and allowing works vide letter dated 06.11.2024 and 14.12.2024. Land owner is not allowing to work due to cracks developed outside RoW , near to his residence at Km 11+800 . However, PMU has directed the EPC Contractor vide letter dated 30.12.2024 for immediate commencement of the protection works for resolution of the same. As per directions of Hon’ble Minister, RT&H during meeting dated 21.10.2024, Shri. Harpal Singh, from Zojilla Tunnel has been approached for visiting the Tunnel & for value inputs on the restoration plan. Consequent to visit on 14.11.2024, meeting and discussions held on 15.11.2024 with the stakeholders. Inputs given by the expert have been forwarded to the AE and Contractor for incorporating in the restoration proposal on 02.12.2024 which was submitted by Contractor after incorporation of the inputs on 10.12.2024 is under review by AE’s. Meanwhile, the EPC Contractor has summited that the restoration plan for the excavated portion to be treated under change of scope as the same was beyond the Contractor’s control. A tentative cost amounting to Rs 23.25 Cr has been submitted for restoration work at Western portal from 10+994 to 11+106 & that the revised design & drawing for the remaining section from chainage 11+106 to 11+500 will be submitted subsequently. After reviewing of the Contractor methodology, AE has recommended to take a considered decision on the Contractor’s request for in-principal approval on the approval of COS as the series of events leading to present state were beyond control of the Contractor . As per the recommendation of AE, the proposal has been recommended for a suitable direction on the matter to RO-Kohima. Tunnel expert committee has visited the site on 04.01.2025 and report has been submitted on 20.01.2025 & the same has been forwarded to AE for implementation of points at site related with restoration activities of Tunnel which are highlighted in the report & close coordination with the EPC Contractor as the committee opines / recommends that all the actions highlighted in the inspection report must be carried out first so that to undertake restoration activities for the safe construction of this tunnel. 3. Issues with Contractor – The works at site does not commensurate with required progress. EPC Contractor has initiated Arbitration Petition under section 11(6) of Arbitration and Conciliation Act on 24.08.2023 for resolution of disputes. SOC is filed by the claimant on 15.03.2024. SOD & Counter Claim filed by NHIDCL on 31.05.2024. Affidavit for admission / denial has been submitted by both the parties. The arbitration hearing was held on 05.12.2024 and both parties to file affidavits for witness examination within 06 weeks. Witness examination of claimant is scheduled on 21.02.2025 & 22.02.2025. Witness examination of respondent is scheduled on 01.03.2025.& 02.03.2025. 4. Other Issues: NOC is received from DC, Kohima for 11.454 Km on 19.02.2024 with remarks- 1.920 Km is sub-judice. Approval of Annulment of Realignment stretch affecting 1.15 Km has been approved by HQ NHIDCL on 08.04.2024 and the same has been conveyed to Contractor on 13.04.2024. P & P in accordance with the scope as per CA is yet to be submitted by contractor till date and therefore, is yet to be got approved by the AE for Km 40+580 to Km 43+454. Moreover, a meeting was convened on 18.12.2024 with AE, contractor, PMU & RO for last 3 km to discuss the EPC Contractor ‘s Claim of COS for 2 nos. of Bridges and 1 Nos. Viaduct, however, any clear-cut response in this regard is still awaited. During site visit of the Hon’ble Chief Secretary, GON on 18.01.2025, it has been directed to complete the road stretch from Km 32+000 to Km 35+000 for vehicular movement. 4. Issues with Contractor: The Contractor has filed the Petition of Arbitration Claim under Section 17 on 15.09.2023, for seeking interim measures of protection. Last hearing regarding arguments on Section 17 was held on 04.03.2024 and the same has been disposed off on 04.03.2024. The proceedings for recording of evidences has been conducted on 31.07.2024 and next date of recording of evidences has been scheduled on 05.02.2025. Despite repeated reminders, the Damaged PMGSY Road (Ch. 40+300) affected in a length of 0.060 Km is not yet taken up by EPC Contractor for restoration. Despite repeated reminders, Contractor yet to start Landslide Mitigation measures at the landslide prone stretches. At Ch. 33+900, a minor bridge ( COS) is required at site instead of culvert as per CA. The separate proposal is initiated by contractor and currently with the AE. The progress of the Contractor was being monitored as agreed during meeting held on 21.10.2024 under the chairmanship of the Hon’ble Minister, RT&H for next two months. Accordingly, in failing to achieve any substantial progress, the EPC Contractor has been served Notice for Intention to Terminate the Contract on 18.01.2025. Action Taken The local hindrances were discussed with the DC, Kohima, Deputy CM, Nagaland during meeting on 16.10.2024, with the Hon’ble Minister, RT&H during meeting on 21.10.2024, with the Revenue Officer, DC office, Kohima on 13.01.2025 and with the Hon’ble CS, GoN during meeting on 18.01.2025 for resolution of Hindrances. Furthermore, a joint verification is scheduled on 07 th Feb’2025. EPC Contractor declared as Non-Performer on 07.03.2023. Fresh Cure Notice period for 60 days under Cl. 23.1(i) of Contract Agreement has been issued to the EPC Contractor on 24.06.2024. However, the Contractor during meeting held under the chairmanship of Dir (T), HQ, NHIDCL requested for extension of cure period. The same is also requested by EPC Contractor vide their letter dated 21.08.2024. PMU in this regard has forwarded a letter to RO-Kohima on 22.08.2024. During meeting held on 21.10.2024 under the chairmanship of the Hon’ble Minister, RT&H, it has been directed to closely monitor the progress and to take suitable action, if no substantial progress is observed in next two months.
