THE MENTAL HEALTHCARE ACT 2017

INTRODUCTION • India has more than 70 million mental health patient. • Less than 4000 psychiatrist are there and they are concentrated in cities. • There are 9.5-102 persons affected in 1000 of population. • About 800,000 people commit suicide worldwide every year, of these 135,000 (17%) are residents of India, a nation with 17.5% of world population. So there is a need for looking towards mental health.

In India, the  Mental Health Care Act 2017  was passed on 7 April 2017 and came into force from 29th May, 2018.

An Act to provide for mental healthcare and services for persons with mental illness and to protect, promote and fulfil the rights of such persons during delivery of mental healthcare and services.

CHAPTER V RIGHTS OF PERSONS WITH MENTAL ILLNESS

AIMS Safeguard the rights of the people with mental illness Access to healthcare and treatment without discrimination Provisions for medical insurance .

Right to access mental health care and treatment. Mental health services of affordable cost & of good quality Available in sufficient quantity Accessible geographically Without discrimination.

2. Right to access mental healthcare services Outpatient and inpatient services Half-way homes, sheltered accommodation Home based rehabilitation Hospital and community based rehabilitation child mental health services and old age mental health services.

3. Integrate mental health services into general healthcare services at all levels of healthcare including primary, secondary and tertiary healthcare and in all health programmes run by the appropriate Government.

Long term care in exceptional case. Mental healthcare services shall be available close to a person with mental illness resides. Mental health services in each district. Emergency mental healthcare services shall be available at all community health centres

4. Persons with mental illness living below the poverty line shall be entitled to mental health treatment and services free of any charge. 5. Right to equality and non- discrimination .

6. Essential Drug List and all medicines on the Essential Drug List shall be made available free of cost to all persons with mental illness. 7. Right to live in community .

8. Right to live with dignity . Live in safe and hygienic environment Adequate sanitary conditions have reasonable facilities for leisure, recreation, education and religious practices; Maintain privacy Proper clothing

To not be forced to undertake work and if they working willingly the provide them with remuneration. Preparing for living in the community Not be subject to compulsory tonsuring (shaving of head hair) Protected from all forms of physical, verbal, emotional and sexual abuse.

9. Every person with mental illness shall be treated as equal to persons with physical illness. No discrimination Emergency facilities and emergency services Use of ambulance services Living conditions in health establishments

A child under the age of three years of a woman receiving care, treatment or rehabilitation at a mental health establishment shall ordinarily not be separated from her during her stay in such establishment. Provision of insurance.

10. Right to information The criteria for admission under that provision. Right to make an application to the concerned Board for a review of the admission. The nature of the person’s mental illness and the proposed treatment plan Receive the information in a language and form that such person receiving the information can understand.

11. Right to confidentiality All information stored in electronic or digital format in real or virtual space. No photograph or any other information relating to a person with mental illness without consent.

EXCEPTION Information to the nominated representative. Information to other mental health professionals and other health professionals. To protect any other person from harm or violence; to prevent threat to life. Information to Board or the Central Authority or High Court or Supreme Court. Public safety and security.

12. Right to access their basic medical records . 13. Right to refuse or receive visitors and to refuse or receive and make telephone or mobile phone calls at reasonable times .

14. A person with mental illness shall be entitled to receive free legal services to exercise any of his rights given under this Act. 15. Right to complain regarding deficiencies in provision of care, treatment and services in a mental health establishment.

RIGHTS OF PERSON WITH DISABILITY ACT 2016

The disabilities, specified in the act, are listed as under Blindness Parkinson’s disease Leprosy cured persons Speech and language disability Hearing impairment Acid attack victim Locomotors disability Thalassemia Autism Sickle cell disease Cerebral palsy Haemophilia Intellectual disability Learning disabilities Muscular dystrophy Low vision

No deprivation of personal liberty on account of disability. Reasonable accommodation.

No compulsion to live a particular living arrangement. Right to range of in house, residential and other community support services, including personal assistance necessary to support living with regard to age and gender.

No separation of a child from his or her parents on the ground of disability except by way of a court order issued in the interest of the child. No medical procedure to cause infertility without the informed and free consent.

Accessibility to polling station. Right equally with others to own and inherit property, control financial affairs and access to financial credit.

Right to alter modify or dismantle any support arrangement prospectively and seek the support of another. Right to employment including promotion in a government establishment without any discrimination.
