GOVERNANCE FRAMEWORK Princely States of Swat, Dir, Chitral & Khanate of Khar (Bajaur) besides Malakand Protected area constitute the present Malakand Division The rule of Wali -e-Swat, Nawab of Dir & Mehtar of Chitral ended in 1969 after annexation Laws, Rules and Customs kept intact - powers of Rulers were delegated to an authority to be appointed by the Provincial Government the Commissioner (1970) Up till 1975 Frontier Crimes Regulation as it existed in Malakand Protected Area was also extended to other parts of the Division 10
PROMULGATION OF PATA REGULATIONS PATA Regulation promulgated in 1975 replacing FCR Special Jirga laws supported by required sections of PPC, CrPC , CPC & Evidence Act envisaged in PATA Regulation Executive officers were bestowed with all judicial and executive powers Deputy Commissioners used to exercise exclusive powers in both civil and criminal cases Civil disputes were resolved by jirgas appointed under PATA regulation PATA regulation abolished by Supreme Court in 1994 Thus resulting a demand of Sharia Law (Islamic Jurisprudence) in a vacuum like environment 11
PROMULGATION OF NIFAZ-E-NIZAM-E-SHARIA REGULATION Complete breakdown of legal and administrative apparatus Major routes including KKH and Malakand Top were blocked Nifaze Nizame Sharia Regulation was enforced in 1994 whereby Zila Qazis , Izafi Zila Qazis and Ilqa Qazis were appointed This regulation was replaced by another similar amended regulation in 1999 which remained operative till 2009 amid continued resistance Though Session courts and Civil courts assumed the powers with new nomenclature but civil disobedience in the form of Tehrik.e.Nifaze Shariat.e.Muhammadi movement (TNSM) of Sufi Muhammad remained active 12
CLIMAX OF MILITANCY AND MILITARY OPERATIONS Seeds of religious extremism sown in 1994 bore fruit in shape of terrorism in 2006 The region witnessed an era of terrorists activities in its full swing from 2006 to 2009 (target killings, car explosions, suicidal bombings and other attacks) Military operations Rah-e- Rast followed by Rah-e- Nijat from 2007 to 2009 after complete evacuation of more than 3 million people from the region Historic displacement – TDPs and subsequent relief, rehabilitation and reconstruction phases is another gigantic task accomplished by the successive administration Peace and normalcy restored in the region after countless sacrifices and efforts 13
PROMULGATION OF SHARIA NIZAM-E-ADL REGULATION A new phenomenon – a new challenge in front of government i.e. defining afresh state-citizen relationship and transfer of powers from military to civil administration Honoring the historic public demand of Sharia, Nizam -e- Adl Regulation , 2009 was enforced It is a concise and comprehensive instrument for dispensing speedy justice and ensuring good governance The regulation envisages the following major components: Dar- ul -Dar- ul - Qaza Dar- ul - Qaza Zila Qazi – Izafi Zila Qazi – Aala Ilaqa Qazi – Ilaqa Qazi District Magistrate – Sub-Divisional Magistrate - Executive Magistrate Timeframe for disposal of criminal cases All cases mentioned in Schedule-III of the regulation are tried by EMs 14
25 th AMENDMENT (MERGER OF FATA/PATA) Both FATA & PATA stand merged through 25 th Amendment of the Constitution of Pakistan through an Act passed by the Parliament of Pakistan and the Khyber Pakhtunkhwa Assembly in May 2018. Under the amendment, the Federally Administered Tribal Areas (FATA) & Provincially Administered Tribal Areas (PATA) were merged with the province of Khyber Pakhtunkhwa (KP) and all laws and jurisdiction of Superior Judiciary are extended uniformly. Now the whole country is governed under a uniform set of laws. 15
