Legal Provision for Export & Import
of Livestock & products in Nepal
Animal Health & Livestock Services Act,2055 has Defined
"Animal" means any domestic or wild animal, and this
word shall also include bird and fish.
"Animal Products" means meat, blood, animal fat,
bile, milk, egg, bone, hide, horn, hoof, feather, wool,
fur, hair, embryo, semen, glands, dung, urine or
unprocessed material made from such items.
"Animal Production Inputs" means processed or
unprocessed material used in animal health or
artificial insemination and other biological products.
"Biologicals" means bacterial or viral vaccines,
medicines or biological chemicals used for the
development of livestock and animal health.

recommendationletterfromtheDepartment.Forthis
thepersonshallsubmitanapplicationontheformat
referredtoinschedule-6alongwithafeeofone
hundredrupees.(rule13subrule1ofAnimalHealth
&LivestockServicesRegulation,2056)
IftheapplicationreferredtoinSub-rule(1)hasbeen
made,theDepartmentshall,ifitdeemsreasonableto
maketherecommendationuponaninquiry,issuethe
recommendationLetterintheformatasreferredtoin
schedule-7.

The terms to be Abided by While Exporting
(rule 14 sub rule 1 & 2 of Animal Health & Livestock Services
Regulation,2056)
(1)WhileExportinganAnimal,TheproductsofanimaloriginorLivestock
Productmaterials,theExportershallabidebythefollowingterms:
AnoticehastobeservedontheconcernedQuarantineofficerin
advancespecifyingthetype,SpeciesandBreedoriginandNumberof
theanimalstobeexportedalongwiththepointandpossibledateof
Export.
Incaseofanimalshavingbeenvisiblymarkedasappropriatesymbol
denotingtheexportableQualityuponExaminationbytheQuarantine
Officer,andhavingobtainedahealthcertificatefromtheVeterinary
Officer.
Thetransportvehicletobeusedforexportingtheanimal,productsof
animaloriginorlivestockProductsmaterialsshouldbedisinfected;
TheProductsofAnimalOriginorlivestockproductsmaterialstobe
exportedhavetobeexaminedbytheQuarantineOfficer,and
Thetransportvehicletobeusedforexportingtheanimalsshouldbe
suitablefromthetechnicalpointofview.
(2)Therecordsoftheanimals,ProductsofanimaloriginorLivestock
Productsmaterialsexportedunderthisruleshallbekeptbythe
concernedQuarantineOfficer.

The Terms to be Followed for Importing
(rule 15 of Animal Health & Livestock Services Regulation,2056)
The Importer shall, while importing animal, animal products or
Livestock Production materials, have to abide by the following
terms:
If, out of the animals Imported, any animals has died during
the course of Journey after having been departed from the
point of Departure, the particulars thereof shall have to be
submitted to the Quarantine Officer:
The Transport vehicle to be used for importing animal origin
or Livestock Products materials have to be disinfected;
The particulars as to identity marks, number or weight and
types of the animal origin or Livestock Products materials
shall have to be submit to the Quarantine Officer at the time
of import
The transport vehicle to de used for transport of the animals
should be suitable from technical point of view.

Responsibilities of the Importing Country
The import requirements included in the international
veterinary certificateshould assure that commodities
imported in the country comply with the national level
of protection that it has chosen for animal and human
health.
The international veterinary certificateshould not
include requirements for the exclusion of the
pathogens or animal diseases which are present
within the territory of the importing countryand are
not subject to any official control program.

Responsibilities of…
The requirements applying to pathogens or diseases
subject to official control programin a country or zone
should not provide a higher level of protection on
imports than that provided for the same pathogens or
diseases by the measures applied within that country
or zone.
The international veterinary certificateshould not
include requirements for the disease agents or
diseaseswhich are not OIE listed, unless the
importing countryhas identified the disease agent as
presenting a significant risk for that country, after
conducting a scientifically based import risk analysis.

ANIMALS
Accept only those animals, which have been subjected
to a health examination by an official veterinarianof the
exporting country and which are accompanied by an
international veterinary certificateprovided by the
veterinary authorityof the exporting country.
Importation of the animalmay be prohibited if it
considers that certain diseases exists in the exporting
country, or transit countries which precede in the
itinerary ,which are capable of being transmitted to its
own animals. In the case of transit countries, the
prohibition is not applied to beeswhich are transported
in securely closed vehicles or containers.

Animals….
Importation of the animal may be prohibited if these are
found on examination at the Border quarantineby an
official veterinarian, to be affected by, suspected of being
affected by or infected with a disease capable of being
transmitted to the animals in its territory.
Animalswhich are not accompanied by an international
veterinary certificateconforming to the requirements of
the importing country’s lawmay also be refused entry.

Animals….
In these circumstances, the veterinary
administrationof the exporting country shall be
informed immediately, thereby providing an
opportunity for confirming the findings or
correcting the certificate. However importing
country may prescribe that the importation is
placed immediately in quarantine in order to
carry out clinical observation and biological
examinations with a view to establishing a
diagnosis.

Animals….
If the diagnosis of an epizootic disease is
confirmed, or if the certificate can not be
corrected, take the following measures -
oreturn the animalsto exporting country, if
this measure does not involve transit
through a third country;
oSlaughter and destroyin cases where return
to the exporting country would be
dangerous from the health point of view or
impossible from a practical point of view.

Animals….
Animals, accompanied by a valid international
veterinary certificateand found to be healthy
by the veterinary authority at the border post,
shall be permitted to be imported and
transported in accordance with the
requirements of the importing country to the
point of destination.

They should only be accepted which are
accompanied by aninternational veterinary
certificate.
Importing country may require adequate
advance noticeregarding the proposed date of
entry into its territory of any consignment of the
above mentioned products, stating the species,
quantity, nature of packaging of the products,
and the name of the border post to be used.

A country may prohibit the importation
of these products into its territory if it
considers that the certain disease exists
in the exporting country, or in the transit
countries which precede it in the
itinerary, which are capable of being
introduced by these products into its
territory.

Prohibit these products, which are not
accompanied by an international veterinary
certificateprovided by the veterinary authorityof
the exporting country.
In these circumstances, the veterinary
administrationof the exporting country shall be
notified at once, and the products may be
returned to the exporting country or placed in
quarantine and/or destroyed.

MEAT

PRODUCTS

Meat…
Meat and products of animal origin
intended for human consumption must be
accompanied by an international
veterinary certificateconforming to the
models approved by the OIE. These must
be worded in the languagesagreed upon
between the exporting country and
importing country, and, where necessary
with the transit countries.

Products of animal origin intended for
use in animal feeding or for
pharmaceutical or surgical or
agricultural or industrial use should be
accompanied by an international
veterinary certificateconforming to the
models approved by the OIE.

Importing country may require adequate
advance noticeregarding the proposed
date of entry of consignment into its
territory of any consignment of the above
mentioned products, stating the nature,
quantity and packagingof the products,
and the name of the border postto be
used.

Meat…
If inspection of the consignment shows that the meat or
the product of animal origin intended for human
consumption might be a danger to the health of person
or animals, or if the international veterinary certificateis
not correct or does not apply to the products, the
veterinary authorityof the importing countrymay cause
the meat or the products to be returned or be subjected
to adequate treatment to ensure that they are safe.
If the products are not returned, the veterinary
administrationof the exporting country shall be informed
immediately, thereby providing an opportunity for
confirming the findings.

Vehicles…
On the arrival of a vehicle transporting an
animal or animals infected with any disease
listed by the OIE at a border post, such
vehicle shall be considered as contaminated,
and the Veterinary Authorityshall apply the
following measures:

Unloading of the vehicle and immediate
transportation of the animal or animals, in a
leak-proof vehicle direct to:
An establishment approved by the Veterinary
Administrationfor the slaughter of the animals
and destruction or possibly sterilization of the
carcasses; or
A quarantine station or, in the absence of a
quarantine station, to a place assigned in
advance which is well isolated and near the
border post;

Unloading of the vehicle and immediate transportation of
the litter, forage and any other potentially contaminated
material to an establishment assigned in advance for
their destruction, and strict application of the animal
health measures required by the importing country;
Disinfection of:
All baggage of the attendants;
All parts of the vehicle which were used in the
transport, feeding, watering, moving and
unloading of the animal or animals;

Disinfection, in cases where any insect vector
diseases are present.
On the arrival at a border post of a vehicle
transporting an animal or animals suspected of
being affected with any disease listed by the
OIE, the vehicle shall be considered as being
contaminated, and the Veterinary Authoritymay
apply the measures provided as above.

VEHICLE….
The vehicle shall no longer be considered as
contaminated when the measures prescribed
by the Veterinary Authorityin accordance with
above have been carried out.
The vehicle may then be allowed to enter.

SHIPS AND AIRCRAFTS
Ships and aircraft should not be refused access
to a port or airport for animal health reasons in
cases of emergency.
Nevertheless, the ship or aircraft should be
subjected to all of the animal health measures
which the port or Airport Veterinary Authoritymay
consider necessary.

An aircraft transporting animals or animal
products need not be regardedas coming
from an infected zone solely because it
landed in such zone at one or more airports
as long as these airports are not infected.
This should be considered direct transit
provided no offloading of animals and
animal products take place.

Any aircraft coming from a foreign country
where animal diseases transmitted by insect
vectorsare present shall be subjected to
disinfectionimmediately after landing, except
when such disinfection was carried out
immediately before departure or during the
flight.
