VETO POWER T he President's disagreement with a proposed law. Congress can override the veto via a 2/3 vote with both houses voting separately, after which the bill becomes law.

PRIVILEGES OF THE PRESIDENT Executive Privilege -the power of the President to withhold certain types of information from the public, the courts, and Congress .

Section 1: vests the executive power on the President of the Philippines.
• PRESIDENT is the head of state and head of government , commander-in-Chief of the Arm Forces of the Philippines (AFP) , control over executive departments , bureaus, and offices, enforces the laws . • Executive branch sets the direction or national policy.
Section 2: President is elected and must be: - Natural-born citizen of the Philippines - Registered voter - Able to read and write - At least 40 years of age on the day of election - Resident of the Philippines for at least 10 years
Section 3: There shall be a Vice-President who shall have the same qualifications and term of office and be elected with, and in the same manner, as the President. He may be removed from office in the same manner as the President. May be appointed as member of the Cabinet.
• In your opinion, should the qualifications for the President and Vice-President be revised? What are the changes that you want to make in the qualifications for the Presidency and Vice-Presidency. Why do you want to change it?
Section 4-12: ELECTION of PRESIDENT and VICE PRESIDENT • Every six years • Presidential Election is held every second Monday of May • Elected by direct vote of the people nationwide • National Board of Canvassers: Congress • Electoral Tribunal: Supreme Court
Section 4-12: TERM OF OFFICE PRESIDENT and VICE PRESIDENT • Starts at June 30 in the year of the election at 12 noon. • Term of office of the President • 6 years w/ re-election • Term of office of Vice President • 6 years, can be re-elected once
Section 4-12: PRESIDENTIAL SUCCESSION Vacancy in the President Vacancy occurs at the start of the term of the Presidents • There is no President-elect • VP acts as President
Section 4-12: PRESIDENTIAL SUCCESSION Vacancy in the President President-elect fails to qualify • VP acts as President- until the question about the President elect has been resolved

Section 4-12: PRESIDENTIAL SUCCESSION Vacancy in the President Death of the President, Permanently disabled removed from office or reigns. • VP becomes President o VP who become President by operation of law and not by election and served less than 4 years can run for the Presidency in the next election.
Section 4-12: VACANCY IN THE VICE PRESIDENT It can happen if the VP became President by operation of the law, dies, become permanently disabled, removed from office or resigned. • The President will nominate a member of Congress to become VP
Section 4-12: VACANCY IN THE VICE PRESIDENT The nomination must be confirmed by a majority vote of all members of both House, voting separately.
Section 4-12: VACANCY IN THE PRESIDENCY AND VICE PRESIDENCY The Congress will call for a special election to elect a President and Vice President.
Section 4-12: VACANCY IN THE PRESIDENCY AND VICE PRESIDENCY However, if the vacancy occurs 18 months before the date of the next Presidential election, then no special election will happen. Senate President acts as the resident until the President or VP shall have been elected
Section 4-12: VACANCY IN THE PRESIDENCY AND VICE PRESIDENCY If the Senate President is unable to acts as President, the Speaker of the House acts as President.
Section 13-16: Power of Appointment -prerogative of the President to determine who should fill an office .
Section 13-16: Power of Appointment • Prohibition on NEPOTISM- the act of using power or influence to give special treatment to relative/workmates. • President cannot appoint his/her spouse, relatives by consanguinity and relatives by affinity to the following position during his tenure.
Section 17: The President shall have control of all the executive departments, bureaus, and offices. He shall ensure that the laws be faithfully executed.
Section 17: 2. Power of Control - power to alter or modify or nullify or set aside what a subordinate offices has done in the performance of his duties and to substitute his judgment for that of the subordinate.
Section 18: The President shall be the Commander-in-Chief of all armed forces of the Philippines and whenever it becomes necessary, he may call out such armed forces to prevent or suppress lawless violence, invasion or rebellion.

Section 19-23 Power of Executive Clemency Pardon -exempts the individual from the punishment the law inflicts for a crime he committed.
Section 19-23 Power of Executive Clemency Pardon TYPES OF PARDON - Absolute Pardon- does not need acceptance and effective immediately - Conditional Pardon – needs acceptance - president determines whether conditions for pardon has been violated.
Section 19-23 Power of Executive Clemency Amnesty - act of granting general pardon to crimes which are political in nature - It is given to a group of person - Granted even before conviction -Needs the approval of the majority of the member of the Congress
Section 19-23 Power of Executive Clemency Reprieve Temporary postponement of the execution of a punishment to a certain date.
Section 19-23 Power of Executive Clemency Commutation reduction of penalty
Section 19-23 Power of Executive Clemency Remission of fines and forfeitures Prevents the collection of fines or confiscation of property
Section 19-23 Power of Executive Clemency LIMITATIONS ON EXECUTIVE CLEMENCY -Cannot be exercised over cases of impeachment -All acts of clemency except amnesty can be given only after conviction by final judgement. -For violation of election laws, grant of pardon, reprieve and amnesty will be granted only with the approval of the COMELEC.
Section 19-23 Borrowing Power -The President can contract and guarantee foreign loans -Must have the approval of the Monetary Board.
Section 19-23 Diplomatic Power -The President can negotiate and sign treaty with another country -For a treaty to be valid and effective, the Senate must ratify/approve it. (Majority needed: at least 2/3 vote or 16 votes)
OTHER DUTIES OF THE PRESIDENT -OTHER DUTIES of the PRESIDENT- -Prepare and submit the national budget to Congress within 30 days from opening of regular session of Congress. -SONA (State of the Nation Address)
