Refugees are governed by general laws meant for foreigners: Foreigners Act, 1946 – No distinction between refugees and other foreigners; government can deport or detain any foreigner. Passports Act, 1967 – Refugees without valid documents are considered illegal immigrants. Citizenship Act & CAA, 2019 – Non-Muslim refugees from Pakistan, Afghanistan, and Bangladesh can get fast-track citizenship, excluding Muslim groups like Rohingyas. Non-Refoulement – India follows the principle of not deporting refugees to places where their lives are at risk, though not legally binding. Role of UNHCR – Provides refugee status and assists refugees, such as Afghans and Rohingyas.

03 Now as we understand about refugee then lets dive into topic that why India is chosen by them in first place? 2025 Why Refugee choose India to settle in first place?

India shares borders with conflict-hit countries like Afghanistan, Myanmar, and Bangladesh. Refugees can cross into India easily without long travel or visas. India does not have a strict refugee law or immediate deportation policies. Many refugees can stay without legal action, even if undocumented. Many refugees share ethnic, linguistic, or religious ties with Indians. The CAA, 2019 allows persecuted non-Muslim refugees from neighboring countries to get fast-track citizenship. India’s large informal job market helps refugees find work easily. NGOs and UNHCR support them with food, shelter, and healthcare. Why Refugee choose India to settle in first place? Use of Technology – Introduced Aadhaar-based ID and biometric tracking to find and prevent illegal stays.

Conclusion Illegal immigration has been a major issue in India, impacting national security, the economy, and social stability. Different governments, including Congress and BJP, have taken steps like border security, citizenship laws, and deportation measures to tackle the problem. However, a long-term solution requires strict law enforcement, advanced technology, and diplomatic efforts with neighboring countries. At the same time, political parties often use this issue during elections to gain votes, making it a subject of debate rather than just a policy concern. A balanced approach that ensures national security while keeping politics aside is essential for real progress.
