(g)“Prescribed”meansprescribedbyrulesor
regulationsmadeunderthisAct;
(h)“StateCouncil”meansaStateDental
Councilconstitutedundersection21,and
includesaJoint[State]Councilconstitutedin
accordancewithanagreementundersection22.
(i)“Register”meansaregistermaintainedunder
thisAct;

(j)“Recognizeddentalqualification”means
anyofthequalificationsincludedinthe
Schedule.
(k).“Recognizeddentalhygienequalification”
meansaqualificationrecognizedbytheCouncil
undersection11.

(l)“RegisteredDentist”,“RegisteredDental
Hygienist”and“RegisteredDentalMechanic”
shallmean,respectively,apersonwhosenameis
forthetimebeingregisteredinaregisterof
dentists,aregisterofdentalhygienistsanda
registerofdentalmechanics.

Constitution and composition of the
council:
Councilcomposedof6constituenciesviz.
centralgovt.,stategovt.,universities,
dentalcolleges,medicalcouncilofindia
anddeantalprivatepractitioners.
Thecouncilconsistingoffollowing
members,namely:

(a)Oneregistereddentistpossessinga
recogniseddentalqualificationelectedbythe
dentistsregisteredinPartAofeachState
register;
(b)onememberelectedfromamongst
themselvesbythemembersoftheMedical
CouncilofIndia;

(c) Not more than four members elected
from among themselves, by -
1)Principals,Deans,DirectorsandVice-
PrincipalsofdentalcollegesintheStates
trainingstudentsforrecogniseddental
qualificationsprovidedthatnotmorethanone
membershallbeelectedfromthesamedental
college.

2)Headsofdentalwingsofmedicalcollegesin
theStatestrainingstudentsforrecognised
dentalqualifications
3)OnememberfromeachUniversityestablished
bylawintheStateswhichgrantsasrecognised
dentalqualification,tobeelectedbythe
membersoftheSenateoftheUniversity.

(d) One member to represent each State
nominated by the Government of each such
State from among persons registered either
in a medical register or a dental register of
the State.

(e)SixmembersnominatedbytheCentral
Government,ofwhomatleastoneshallbea
registereddentistpossessingarecogniseddental
qualificationandpractisingorholdingan
appointmentinaninstitutionforthetrainingof
dentists,andatleasttwoshallbedentists
registeredinPartBofaStateregister.

(f)theDirectorGeneralofHealthServices
(exOfficio).

Mode of elections
Elections shall be conducted in the
prescribed manner, and where any dispute
arises, it shall be referred to the Central
Government whose decision shall be final.

TERM OF OFFICE AND CAUSAL
VACANCIES
1) An elected or nominated member shall
hold office for a term of five years from
the date of his election or nomination or
until his successor has been duly elected or
nominated,whichever is longer:

2) An elected or nominated member may at
any time resign his membership by writing
under his hand addressed to the President,
and the seat of such member shall
thereupon become vacant.

3) An elected or nominated member shall be
deemed to have vacated his seat if he is absent
without excuse, sufficient in the opinion of the
Council, from three consecutive ordinary
meetings of the Council or, in the case of a
member who was elected among principals and
Deans of dental colleges if he ceases to hold his
appointment as the Principal, Dean, Director or
Vice-Principal as the case may be.

4) A casual vacancy shall be filled by fresh
election or nomination, as the case may be,
and the person elected or nominated to fill
the vacancy shall hold office only for the
remainder of the term for which the
member whose place he takes was elected
or nominated.

5) Members of the Council shall be eligible
for re-election or re-nomination.
6) No act done by the Council shall be
called in questionon the ground merely of
the existence of any vacancy in, or defect
in the constitution of, the Council.

President and Vice President of the
Council
PresidentandVice-Presidentofthe
Councilshallbeelectedbythemembers
(thereof)fromamongthemselves.
AnelectedPresidentorVice-President
shallholdofficeassuchforatermnot
exceedingfiveyearsandnotextending
beyondtheexpiryofhistermasmember
oftheCouncil,butsubjecttohisbeinga
memberoftheCouncil,heshallbeeligible
forre-election.

Executive Committee shall consist of:
the President and Vice-President ex officio
and the Director-General of Health
Services ex officio, and five other members
elected by the Council.

ThePresidentandVice-PresidentoftheCouncil
shallbeChairmanandVice-Chairman,
respectively,oftheExecutiveCommittee.
AmemberoftheExecutiveCommitteeshall
holdofficeuntiltheexpiryofhistermofoffice
asmemberoftheCouncilbut,subjecttohis
beingamemberoftheCouncil,heshallbe
eligibleforre-election.

Additiontothepowersanddutiesconferredand
imposedonitbythisAct,theExecutive
Committeeshallexerciseanddischargesuch
powersanddutiesasmaybeprescribed.

Recognition of Dental Qualifications
1)Thedentalqualifications,grantedbyany
authorityorinstitutioninIndia,whichare
includedinPartIoftheScheduleshallbe
recognized;forthepurposesofthisAct.

2.AnyauthorityorinstitutioninIndiawhichgrants
adentalqualificationnotincludedinPartIofthe
SchedulemayapplytotheCentralGovernment
tohavesuchqualificationrecognisedand
includedinthatPart.
TheCentralGovernment,afterconsultingthe
Council,asitmaythinkfitforthepurpose,(may,
bynotificationintheOfficialGazette),amend
PartIoftheSchedulesoastoincludesuch
qualificationtherein,andanysuchnotification
mayalsodirectthatanentryshallbemadein
PartIoftheScheduleagainstsuchdental
qualificationdeclaringthatitshallbea
recognizeddentalqualificationonlywhen
grantedafteraspecifieddate.

3)(a)Thedentalqualifications,(PGcertificateof
dentistryZDS,DDS,Diploma),grantedbyany
authorityorinstitutionoutsideIndia,whichare
includedinPartIIoftheScheduleshallbe
recogniseddentalqualificationsonlyforthe
purposesoftheregistrationofcitizensofIndia
whentheregisterisfirstpreparedunderthisAct.

b)Whereanydentalqualificationgrantedbyany
authorityorinstitutionoutsideIndia,andheldby
acitizenofIndia,isrecognisedforthepurposeof
theregisterwhenitisfirstprepared,afterthe
commencementoftheDentists(Amendment)
Act,1972,theCentralGovernmentmay,after
consultationwiththeCouncil,bynotificationin
theOfficialGazette,amendPartIIofthe
Schedulesoastoincludethereinthedental
qualificationsorecognised.

4)(a)Thedentalqualificationgrantedbyany
authorityorinstitutionoutsideIndia,whichare
includedinPartIIIoftheSchedule,shallbe
recogniseddentalqualificationforthepurposes
ofthisAct,butnopersonpossessinganysuch
qualificationshallbeentitledforregistration
unlessheisacitizenofIndia.

(b)Whereanydentalqualificationgrantedbyany
authorityorinstitutionoutsideIndia,andheldby
acitizenofIndia,isrecognised,excepton
reciprocalbasis,afterthecommencementofthe
Dentists(Amendment)Act,1972,theCentral
Governmentmay,afterconsultationwiththe
Council,bynotificationintheOfficialGazette,
amendPartIIIoftheSchedulesoastoinclude
thereinthedentalqualificationsorecognised.

5)TheCouncilmayenterintonegotiationswithany
authorityorinstitutioninanyStateorcountry
outsideIndiawhichisentrustedwiththe
maintenanceofaregisterofdentists,forthesettling
ofaschemeofreciprocityfortherecognitionof
dentalqualificationsandinpursuanceofanysuch
scheme.
CentralGovernmentmay,bynotificationinthe
OfficialGazette,declarethatanysuchqualification
grantedbyanyauthorityorinstitutioninanysuch
Stateorcountry,orsuchqualification,onlywhen
grantedafteraspecifieddate,shallbearecognised
dentalqualificationforthepurposesofthisAct.

6)TheCentralGovernmentmay,afterconsultation
withtheCouncil,bynotificationintheOfficial
Gazette,amendtheSchedulebydirectingthatan
entrybemadethereininrespectofanydental
qualificationdeclaringthatitshallbea
recogniseddentalqualificationonlywhen
grantedbeforeaspecifieddate.

Qualifications of Dental Hygienist
AnyauthorityinaStatewhichgrantsaqualification
fordentalhygienistsmayapplytotheCouncilto
havesuchqualificationrecognised.

Qualifications of Dental Mechanics
TheCouncilmayprescribetheperiodand
natureofanapprenticeshiportraining
whichshallbeundergoneandtheother
conditionswhichshallbesatisfiedbya
personbeforeheisentitledtoberegistered
underthisActasadentalmechanic.

Effect of Recognition
Anyrecognizeddentalordentalhygiene
qualificationshallbeasufficientqualificationfor
enrolmentintheappropriateregisterofanyState.
Nopersonshallbeentitledtobeenrolledinany
registerasadentistordentalhygienistunlesshe
holdsarecognizeddentalordentalhygiene
qualificationorasadentalmechanicunlesshe
hasundergonetrainingwhichsatisfiesthe
prescribedrequirements.

Withdrawal of Recognition
1)When upon report by the Executive Committee
it appears to the Council:-
a)Thatthecourseofstudyandtrainingorthe
examinationsarenotinconformitywith
regulationsmadeunderthisActorfallshortof
thestandardsrequired,
OR

b)Thataninstitutiondoesnotsatisfythe
requirementoftheCouncilinmatterofstaff,
equipment,accomodation,trainingetc.
TheCouncil,maysendtotheGovernmentof
theStateinwhichauthorityorinstitutionis
situatedastatementtosucheffect,andtheState
Governmentshallforwardit,alongwithsuch
remarksasitmaythinkfit,totheauthorityor
institutionconcernedwithanintimationofthe
periodwithinwhichtheauthorityorinstitution
maysubmititsexplanationtotheState
Government.

2)Onreceiptoftheexplanation,oronthe
expiryofthefixedperiod,theState
Governmentforwarditsrecommendations
totheStateCouncil.

3)TheCouncil,afterconsideringthe
recommendationsoftheStateGovernment
andtheStateCouncilandaftersuchfurther
inquiry,maydeclarethatthequalification
grantedbytheauthorityorinstitutionshall
bearecognisedqualificationonlywhen
grantedbeforeaspecifieddate.

Mode of Declarations
Alldeclarationsshallbemadebya
resolutionpassedatameetingofthe
Councilandshallforthwithbe
publishedintheOfficialGazette.

Professional conduct
1) The Council may prescribe standards of
professional conduct and etiquette or the
code of ethics for dentists.
(2) Regulations made by the Council may
specify which violations thereof shall
constitute professional misconduct.

The Indian Register
(1)TheCouncilshallmaintainaregisterof
dentiststobeknownastheIndianDentists
Registerandconsistingoftheentriesinall
theStateRegistersofdentists.
(2)EachStateCouncilshallsupplytothe
CounciltwentyprintedcopiesoftheState
registerassoonasmaybeafterthe1stday
ofAprilofeachyear,andeachRegistrar
shallinformtheCounciladditionstoand
otheramendmentsintheStateregister.

State Dental Councils
Chapter-III

TheStateGovernmentshallconstitutea
StateCouncilconsistingofthefollowing
members:

CONSTITUTION AND COMPOSITION
OF STATE COUNCILS
(a) Four members elected from among
themselves by dentists registered in Part A of the
State register.
(b) Four members elected from among
themselves by dentists registered in Part B of the
State register.
(c) The heads of dental colleges, if any, in the
State which train students for any of the
recognised dental qualification included in Part I
of the Schedule.

(d) one member elected from amongst
themselves by the members of the Medical
Council of the State.
(e) Three members nominated by the State
Government
(f) The Chief Medical Officer of the State.

Inter State Agreement
(1) Two or more State Governments may
enter into an agreement-
(a) for the constitution of a Joint State
Council for all the participating States, or
(b) for the State Council of one State to serve
the needs of the other participating States.

(3) An agreement under this section shall be
published in the Official Gazettes of the
participating States.

TheStateGovernmentpreparesaregisterof
dentistsfortheState.
TheStateCouncilassumethedutyof
maintainingtheregisterinaccordancewiththe
provisionsofthisAct.

Theregistershallincludethefollowing
particulars,namely:-
–(a)fullname,nationalityandresidential
addressoftheregisteredperson;
–(b)dateofhisfirstadmissiontotheregister;
–(c)qualificationforregistration,andthedate
onwhichheobtainedhisdegreeordiplomain
dentistry,ifany,andtheauthoritywhich
conferredit;
–(d)professionaladdress

First Preparation of The Register
StateGovernmentshallconstitutea
Registrationtribunalconsistingofthree
personsandaRegistrarwhoshallactas
SecretaryoftheTribunal.
TheStateGovernmentshallappointadate
forregistration,whichshallbe
accompaniedbytheprescribedfee,shall
bemadetotheRegistrationTribunal.

Qualification for entry on first
preparation of Register
(1)Apersonshallbeentitledonpayment
oftheprescribedfeetohavehisname
enteredontheregisterwhenitisfirst
prepared,ifheresidesorcarriesonthe
professionofdentistryintheStateandif
he—
(a)holdsarecogniseddentalqualification,
or

(b)doesnotholdsuchaqualificationbut,
beingaCitizenofIndiahasbeenengaged
inpracticeasadentistashisprincipal
meansoflivelihoodforaperiodofnotless
thanfiveyears.

Registers of Dental Hygienists and
Dental Mechanics
StateCouncilshallmaintainaregisterofdental
hygienistsoraregisterofdentalmechanics.
personshallbeentitledonpaymentofthe
prescribedfeetohavehisnameenteredinthe
registerofdentalmechanics,ifhesatisfiesthe
prescribedrequirements

Renewal fees
aRenewalfeeifnotpaidbeforethedue
date,theRegistrarshallremovethename
ofthedefaulterfromtheregister:
Providedthatanamesoremovedmaybe
restoredtotheregisteronpaymentinsuch
mannerasmaybeprescribed.
Onpaymentoftherenewalfee,the
registrarshallissueacertificateofrenewal
andsuchcertificateshallbeproofof
renewalofregistration.

Transfer of registration
WhereadentistregisteredinoneStateis
practicingdentistryinanotherState,hemay,
onpaymentoftheprescribedfeewhichshall
notexceeditsrenewalfeeforregistrationin
suchotherState,makeanapplicationinthe
prescribedformtotheCouncilforthetransfer
ofhisname,fromtheregisteroftheState
whereheisregistered,totheregisterofthe
Stateinwhichheispracticingdentistry,

Ifanypersonwhosenameisnotforthetime
beingenteredinaregisterfalselyrepresents
thatitissoenteredheshallbepunishableon
firstconvictionwithfinewhichmayextendto
500rupees,
Andonanysubsequentconvictionwith
imprisonmentwhichmayextendtosixmonths
orwithfinenotexceeding1000rupeesorwith
both.

–Ifanypersonwhosenamehasbeen
removedfromaregisterfailswithout
sufficientcausetosurrenderhis
certificateofregistrationorcertificateof
renewal,orboth,heshallbepunishable
withfinewhichmayextendto50rupees
permonthandinthecaseofcontinuing
offencewithanadditionalfinewhich
mayextendto2rupeesperdayafterthe
firstdayduringwhichtheoffence
continues.

CHAPTER V
MISCELLANEOUS
-(1) Whenever it appears to the Central
Government that the Council is not complying
with any of the provisions of this Act, the
Central Government may appoint a
Commission of Enquiry.
–(2) The Commission shall proceed to enquire
in a summary manner and report to the Central
Government on the matters referred to it
together with such remedies, if any, as the
Commission may like to recommend.

theCentralGovt.,MinistryofHealth&Family
Welfare.
