TheEpidemicDiseasesAct,1897isanacttoprovideforthebetter
preventionofthespreadofDangerousEpidemicDiseases.
Unlessprovidedotherwise,itextendstothewholeofIndia.
TheeightPartBStateswere-Hyderabad,JammuandKashmir,
MadhyaBharat,Mysore,PatialaandEastPunjabStatesUnion
(PEPSU),Rajasthan,Saurashtra,andTravancore-Cochin.(TheStates
ReorganizationAct,1956)

IfStateoranypartthereofisvisitedby,orthreatenedwith,an
outbreakofanydangerousepidemicdisease,andiftheStatethinks
thattheordinaryprovisionsofthelawforthetimebeinginforceare
insufficientforthepurpose,maytake,orrequireorempowerany
persontotake,suchmeasuresand,bypublicnotice,prescribesuch
temporaryregulationstobeobservedbythepublicorbyanyperson
orclassofpersonsasitshalldeemnecessarytopreventtheoutbreak
ofsuchdiseaseorthespreadthereof,andmaydetermineinwhat
mannerandbywhomanyexpensesincurred,includingcompensation
adifany,shallbedefrayed.Theymaytakemeasuresandprescribe
regulations.

1)Inspectionofpersonstravellingbyrailwayorotherwise
2)Segregation,inhospital,temporaryaccommodationorotherwise,
ofpersonssuspectedbytheinspectingofficerofbeinginfected
withanysuchdisease.

2A. Powers of Central Government
WhentheCentralGovt.issatisfiedthatIndiaoranypartthereofis
visitedby,orthreatenedwith,anoutbreakofanydangerous
epidemicdiseaseandthattheordinaryprovisionsofthelawforthe
timebeinginforceareinsufficienttopreventtheoutbreakofsuch
diseaseorthespreadthereof,theCentralGovt.maytakemeasures
andprescriberegulationsfortheinspectionofanyshiporvessel
leavingorarrivingatanyportinandforsuchdetentionthereof,orof
anypersonintendingtosailtherein,orarrivingthereby.
3.PENALTY:Anypersondisobeyinganyregulationorordermade
underthisActshallbedeemedtohavecommittedanoffence
punishableu/s188oftheI.P.C.-IndianPenalCode(45of1860).

Nosuitorotherlegalproceedingshalllieagainstanypersonfor
anythingdoneorinGOODFAITHintendedtobedoneunderthis
Act.

Section 188 of I.P.C.
Disobediencetoorderdulypromulgatedbypublicservant.—
Whoeverdisobeyslawfuldirectionofapublicservant,shall,ifsuch
disobediencecausesortendstocauseobstruction,annoyanceor
injury,orriskofobstruction,annoyanceorinjury,toanyperson
lawfullyemployed,bepunishedwithsimpleimprisonmentforaterm
whichmayextendtoonemonthorwithfinewhichmayextendto
twohundredrupees,orwithboth;andifsuchdisobediencecauses
ortrendstocausedangertohumanlife,healthorsafety,orcauses
ortendstocauseariotoraffray,shallbepunishedwith
imprisonmentofeitherdescriptionforatermwhichmayextendto
sixmonths,orwithfinewhichmayextendtoonethousandrupees,
orwithboth.

S. 188 -Explanation & Illustration
Itisnotnecessarythattheoffendershouldintendtoproduceharm,
orcontemplatehisdisobedienceaslikelytoproduceharm.Itis
sufficientthatheknowsoftheorderwhichhedisobeys,andthathis
disobedienceproduces,orislikelytoproduce,harm.
ILLUSTRATION
Anorderispromulgatedbyapublicservantlawfullyempoweredto
promulgatesuchorder,directingthatareligiousprocessionshallnot
passdownacertainroad/area.PartyAknowinglydisobeysthe
order,andtherebycausesdangerofriot.PartyAhascommittedthe
offencedefinedinthissection.

1)Section269-Negligentactlikelytospreadinfectionofdisease
dangeroustolife-Breachshallbepunishedwithimprisonmentof
eitherdescriptionforatermwhichmayextendto6months,or
withfine,orwithboth.
2)Section270-Malignantactlikelytospreadinfectionofdisease
dangeroustolife—Breachshallbepunishedwithimprisonment
ofeitherdescriptionforatermwhichmayextendto2years,or
withfine,orwithboth.
3)Section271-Disobediencetoquarantinerule–Breachshallbe
punishedwithimprisonmentofeitherdescriptionforaterm
whichmayextendto6months,orwithfine,orwithboth.
