PRICE GOUGING IN PINELLAS PROBATE ESTATE ADMINISTRATION

I never thought I would have to fight this battle. I am Alessandra Kurchinski, a widow, left to protect my daughters after my husband Franklin passed away. Instead of finding fairness in court, I found exploitation.

Complaint: Price Gouging by Speci
Probate Estate Administration —

Master Magistrate “Judge” in
jellas Circuit Court, Florida

Robert Persante (Bar #376698)

Estato Valued at $2,863.50 vs. Hearing/Trial Cost of $12,067.75

Dear Bar Counsel,

My name is Alessandra C. Kurchinski, widow of Franklin R.
Kurchinski. 1 come to you not as a lawyer, but as a grieving wife
and mother who has been forced into a nightmare of what | believe
to be “price gouging” and exploitation during my husband's probate
estate cases (22-0010189-ES and 23-007034-C1).

On October 26, 2023, my family endured a trial before
Special Master Magistrate Robert Persante. Only later, in the
‘Second Annual Accounting sent on October 28, 2024 by Personal
Representative Nancy Gorby, did I discover that Mr. Persante had
charged an outrageous $12,067.75 for this one hearing. My
husband's estate involved only $2,863.50 in assets — yet
somehow, the cost of a single hearing was more than four times
the value of the entire estate.

These charges were never disclosed to me or my daughters,
Jacqueline and Caroline, who are the beneficiaries. We were not
given any opportunity to consent or object. I never even received
an invoice. The money was simply taken — directly from my share
and from my daughters’ shares of the estate.

Before the trial, on October 13, 2023, | sent an email to
Circuit Judge Sherwood Coleman stating clearly that we did not
agree with using our family trust funds to cover the Special
Master/Magistrate's costs. | never received a reply. | had always

believed judges were paid by the State of Florida, not by grieving
widows and young beneficiaries.

The trial itself lasted about 6 hours (with one break) and
produced a 155-page transcript. Even if charged by the hour, |
‘cannot understand how this results in a bill of $12,067.75. At that
time, | was grieving, unrepresented, and my daughter Jacqueline,
only 19 years old, had to appear “pro se" in a language that is not
her first. We were vulnerable — and we were taken advantage of.

| also question the conflict of interest. | had once tried to hire
Mr. Persante as my attorney, but he declined. Later, he was
appointed to act as “the judge" in my family’s case. His decisions
appeared aligned with the opposing party, leaving me to question
his impartiality.

Meanwhile, the estate was drained by others charging
shocking rates:

+ Mediator George W. Greer - $400/hour (proposed by
Nancy Gorby).

+ Guardian Ad Litem Linda Allan — appointed at
S350/hour, but later petitioned for $450/hour. After 1
objected, her fees were reduced from $16,470.00 to
$12,985.75, saving $3,485.00.

+ Resident Agent Attomey Michael Kouskoutis -
S450/hour. His paralegal Mary Andersen - $175/hour.
el Kouskoutis — already paid $62,375.59 from the
estateltrust, then requested an additional $87,169.60
+ Nancy Gorby (Personal Representative / Successor

Trustee) - requested $47,111.50 in payment.

These charges piled up while the actual estate — the assets
my husband left for his family — shrank. None of these people
benefited the Estate. They only benefited themselves, leaving less
for me and my daughters, who were supposed to be protected.

And yet, in all of this, | still do not know: Who proposed Mr.
Persante to act as Special Master Magistrate in my husband's
case? I was never told who selected him. | had no chance to
object. His enormous “payment” came from my assets and my
daughters’ assets without our knowledge, without an invoice, and
without a court order.

To me, this is a clear example of “price gouging” in estate
administration — exploiting a grieving widow and her young
daughters during the most vulnerable time of our lives.

| respectfully and urgently ask the Bar Association to
investigate Mr. Persante's conduct and compensation in this
matter, and to take steps to prevent other Florida families from
being subjected to this kind of exploitation and abuse.

Very rope
ANA

Your Honor, ' tke to know ifthe attomey, Michael Kouskoutis involved in Motion 4156, is the same
attorney mentioned in Report #160, where Robert Persant, Esq, was appointed as Special
Master/Magistrate on October 4, 2023,

We don't agree with using our family trust funds to cover the Special Master/Magistrate's costs. My

to distribute the amount that we want, because we

don't know if we're going to ask for $1,000 but

they're going to take 3,000 out of the trust for,
Like, legalities and paying for things, which is why
we never ask, because we don’t know the amount of
money that they're going to take for fees.

THE COURT: Well, that's a good point. So tell

me, how does this fee structure work?

MR. KOUSKOUTIS: Actually, Your Honor

and 1

did say this to you

that that's not my job as the
attorney. The trustee is not going to charge you for
doing -- the writing a check for your expenses. I

mean, that's -- there's no legal fee involved for the

trustee adhering to the terms of the trust.
A Le COURS me

THE COURT: So as I understand the way this
trust is set up, and this is the way most of then

are, and this ie the way I think the billing goes,

okay, that most people charge a percentage of the
assets held in the trust. They charge -- they get a
percentage of that. Okay? And that should cover
everything. In other words, you shouldn't be charged
extra if you have a request. That should cover all
of that. What you see in this estate is a request
for extraordinary fees because of Litigation. So you

get an ordinary fee, which is normally a percentage,

In addhion o this matter, | would ike to bring to your attention the Issue ofthe family allowance, amounting to

‘hich has pettoned forthe Abandonment of Property by the Personal Representative. Despite our repeated
requests for reimbursement, we have faced challenges, Incluing a response to one of our petitions,
DOGH128, stating a Motion to Strike Claim was fled (Creditor Period)

My late husband, in is wil, expressed a clear wish o prevent his probate from going tothe estate. He had
financialy planned for his funeral to protect is family from emotional stress and financial Burden.
Unfortunately, the current situation seems to contradict his intentions, causing emotional and financial distress
tou

Ve kind request detailed information from the Personal Representative (PR) on the expenses incured since
my husband's passing on August 12, 2022, using funds from the fami’ trust.

“On September 28, 2023, the PR/Successor Trustee submitted a motion involving a special master, andthe

‘According to Florida Statutes (36.811, FS), a ustes is obigated to take reasonable steps to enforce claims

“The fee shitng from the estate's size, fat fees to hourly rates associated with managing the probate estate

Furthermore, the unexpected bil received on May 19, 2023, wth the Activty Log Attomey (Doc #80), revealed:
