LEGAL BASIS 01 Republic Act No. 7796 (TESDA Act of 1994) Republic Act No. 7796 (TESDA Act of 1994) empowers TESDA to establish and maintain a system of accrediting, coordinating, integrating, monitoring and evaluating formal and non-formal TVET Programs. 02 TESDA Board Resolution No. 98-03 dated January 23, 1998 Further, it was supported by a TESDA Board Resolution No. 98-03 dated January 23, 1998, which promulgated the establishment of the Unified TVET Program Registration and Accreditation System . The adoption of the UTPRAS is to ensure the quality of TVET Programs offered to the public.

W H A T I S U T P R A S

Section 8 of R.A. 7796 and TESDA Board Resolution 98-03 as reiterated by TESDA Circular No. 45 series 2007 mandates all technical-vocational programs being offered to the public to be registered under TESDA. Program Registration prescribes full compliance with the minimum requirements prescribed in the Training Regulations and anchored on the competency-based system. PROGRAM REGISTRATION Registration of all Technical-Vocational Education and Training programs offered by both public and private TVI’s under TESDA. (Mandate under Section 8 of R.A. 7796 and TESDA Board Resolution 98-03 as reiterated by TESDA Circular No. 45 series of 2007)

GENERAL PRINCIPLES 01 UTPRAS ensures the quality of TVET programs The UTPRAS is primarily intended to promote public interest and welfare by ensuring the quality of all TVET programs . 02 Program registration is anchored on the competency-based system The registration system is anchored on the competency-based system wherein TVET programs adopt the qualification titles being prepared for and the competency or set of competencies that are to be acquired; 03 Prescribes compliance with minimum standards The registration system prescribes compliance with minimum standards provided for in the TRs promulgated by the TESDA Board.

PROGRAM REGISTRATION REQUIREMENTS LETTER OF INTENT SPECIAL LAW CREATING THE INSTITUTION The letter of application specifying the intent to offer TVET program(s) Board Resolution to offer TVET program(s). This should be signed by the Board Secretary and attested by the Chairperson (SUCs, LCUs and private institutions). If the institution is created under Special Law (for public institutions) they must specify and attach a copy of the law, either by virtue of the Republic Act or an Executive Order, etc. BOARD OF RESOLUTION TO OFFER THE PROGRAM Corporate and Administrative Documents

PROGRAM REGISTRATION REQUIREMENTS SECURITIES AND EXCHANGE COMMISSION (SEC) REGISTRATION CERTIFICATE OF BUILDING OWNERSHIP OR LEASE CONTRACT It must be duly registered with the Security and Exchange Commission (SEC) and must specifically cover the training delivery site (for private institution only). The Articles of Incorporation must specifically state the offering of TVET programs in the primary purpose(s). Proof or Certificate of Building Ownership or contract of lease which covers at least 2 years ARTICLES OF INCORPORATION Corporate and Administrative Documents

PROGRAM REGISTRATION REQUIREMENTS COMPETENCY-BASED CURRICULUM F16 INSTRUCTIONAL MATERIALS The curriculum and the program delivery should be competency-based The equipment, tools, and consumables needed to deliver the program must be listed and submitted using the prescribed forms The Instructional materials (reference materials, slides, videotapes, interned access and library resources) needed to deliver the program must be specified using the prescribed form. PROGRAM REGISTRATION REQUIREMENTS F17 – F18 PHYSICAL AND OFF- CAMPUS FACILITIES WITH SHOP LAYOUT F21 LIST OF NON-TEACHING STAFF The location and list of Physical Facilities and Off-Campus Physical Facilities specifying the floor area. The listing of school officials and personnel should be attached including their individual PDS, while the teaching personnel with their qualifications, areas of expertise and courses/seminars attended including the NC certificate required should be attached The listing of school non-teaching staffs should be attached including their individual PDS and service record F-19 –F20 LIST OF OFFICIALS AND TEACHING STAFF Curriculum and Program Delivery

PROGRAM REGISTRATION REQUIREMENTS SCHEDULE AND BREAKDOWN OF TUITION FEES ENTRY REQUIREMENTS FOR THE PROGRAM The applicant TVI shall also submit the schedule and breakdown of tuition fees and other fees duly signed by the school head indicating the school year of effectivity . The documented grading system shall also be submitted, details of which should be known by all students/trainees at the start of the program. The entry requirements for the program should comply with the relevant training regulations whenever applicable. DOCUMENTED GRADING SYSTEM Academic Rules

PROGRAM REGISTRATION REQUIREMENTS HEALTH SERVICES COMMUNITY OUTREACH PROGRAM The school should also provide health services to the students/trainees, if these services are contracted out or outsourced, these should be covered by a contract or a MOA or other similar documents of understanding must also be submitted. There should be career guidance services made available to the students/trainees in the school. Community outreach program (optional but documented evidences should be available) CAREER GUIDANCE SERVICES Support Services

PROGRAM REGISTRATION REQUIREMENTS Research (optional) that supports the operation of the school is carried out (e.g. surveys, consultations, FGD, etc.) RESEARCH THAT SUPPORTS THE OPERATION OF THE SCHOOL IS CARRIED OUT Academic Rules

Schedule of fees For Additional Program Application In case the school wishes to register additional program(s) the following shall be submitted Numbers 1 to 8.

NTR PROGRAM REGISTRATION Requirements for the NTR programs registration: 1. Must lead toward employment opportunities; 2. Must satisfy any of the following conditions: i. The manpower requirement of critical emerging industry or specific area requirements ii. The industry with high employment potentials iii. The employment commitment from enterprises iv. The regulatory and licensing requirements for the practice of an occupation/profession

Focal person recommends to the PO/DO the conduct of ocular inspection if the documents are in order 8. Review of application document shall be conducted not more than 15 working days. PO/DO UTPRAS focal person prepares final inspection report/recommendation and submits to PO/DO Director 3. PO/DO Director submits recommendation to the RD for issuance of Letter of Denial or CTPR 4. Issuance of CTPR/Letter of Denial Regional Director d. Issue Certificate of Program Registration / Letter of Denial 1. RO UTPRAS Focal conducts final review of documents, returns documents if there are deficiencies; 2. PO/DO UTPRAS focal returns documents to institution and outlines the corrective actions needed; 3. Institution comply with the deficiencies within one (1) week; 4. PO/DO prepares memorandum to RO based on the corrective actions taken then recommends issuance of CTPR or Letter of Denial; 5. RO prepares CTPR or Letter of Denial 6. Regional Director signs CTPR or Letter of Denial 7. RO releases CTPR or Letter of Denial to PO/DO, then PO/DO releases CTPR or Letter of Denial to the TVI 8. Release of CTPR shall be done within one (1) week after receipt of recommendation from PO/DO PROGRAM REGISTRATION FLOWCHART

COMPLIANCE AUDIT The RO submits to TSDO the list of programs to be audited every first quarter of the year The sea-based program are subjected to compliance audit every first quarter of the year Unscheduled compliance audit may be conducted due to: 1. customer complaints and 2. recurring quality problems

SANCTIONS AND PENALTIES Grounds for imposing sanctions and penalties : Unauthorized offering of an unregistered TVET programs; Advertisement of an unregistered programs Discovery of fraud or deceit in connection with the application for program registration

SANCTIONS AND PENALTIES b. Sanction/Penalties to be imposed: Criminal liability A fine of not less than P 2,000.00 no more than P 10,000.00 or Imprisonment for a maximum of 2 years or both at the discretion of the court (if the corporation commits the act, the school head together with the person/s responsible for the offense shall equally be liable. Sanctions against the school shall be without prejudice to the right of the aggrieved students, teachers and employees to after the erring officials and TVIs.

GROUNDS FOR PROGRAM CLOSURE AND REVOCATION OF CTPR Failure of the TVI to comply with the non-compliance/deficiencies within a prescribed period as found in the compliance audit. Failure of the TVI to re-register/migrate program within a prescribed period Employment rates of the graduates of an NTR program is lower than the national average for 3 consecutive batches. Mismanagement or gross inefficiency of the school personnel in the operation of the school and its program offering; Fraud, falsification, misrepresentation, or any similar acts of the TVI.
