Vigilance Awareness Week observed to combat corruption

VIGILANCE ORGANISATION IN INDIA CVC – CENTRAL VIGILANCE COMMISSION (website : www.cvc.nic.in) Apex Body at National level having jurisdiction over central Govt. Ministries and PSUs. Manned by Chief Vig . Commr . and to Vig . Commrs . Issues directives to various Ministries which in turn issue procedure orders for their own Departments.

Objective of Vigilance Prevention of corruption. Promotion of Integrity. Promotion of Vigilance consciousness Effecting system improvement. Advise suitable administrative or disciplinary action.

APPOINTMENT OF CVC The Central Vigilance Commissioner and the Vigilance Commissioners are appointed by the President after obtaining the recommendation of a Committee consisting of: The Prime Minister — Chairperson The Home Minister — Member. The Leader of the Opposition in the Lok Sabha — Member

ROLE OF CVC The CVC is not an investigating agency, and works through either the CBI or through the Departmental Chief Vigilance Officers. The only investigation carried out by the CVC is that of examining Civil Works of the Government which is done through the Chief Technical Officer. …….. contd

Corruption investigations against government officials can proceed only after the government permits them. The CVC publishes a list of cases where permissions are pending, some of which may be more than a year old. The Ordinance of 1998 conferred statutory status to the CVC and the powers to exercise superintendence over functioning of the Delhi Special Police Establishment, and also to review the progress of the investigations pertaining to alleged offences under the Prevention of Corruption Act, 1988 conducted by them …….. contd

In 1998 the Government introduced the CVC Bill in the Lok Sabha in order to replace the Ordinance, though it was not successful. The Bill was reintroduced in 1999 and remained with the Parliament till September 2003, when it became an Act after being duly passed in both the Houses of Parliament. The CVC has also been publishing a list of corrupt government officials against which it has recommended punitive action.

How to Lodge a Complaint ?

1)By lodging a complaint under Government of India, resolution of “THE PUBLIC INTEREST DISCLOSURE AND PROTECTION OF INFORMER (PIDPI)” (The Whistle Blowers Resolution)” in the following manner: ………. contd

2)Commission will not entertain anonymous/ pseudonymous complaints. 3)The text of the complaint should be carefully drafted so as not to give any details or clue as to his/ her identity. However, the details of the complaint should be specific and verifiable. ……… contd

4)The complaint should be in a closed/ secured envelope. 5)The envelop should be addressed to Secretary, Central Vigilance Commission, SATARKATA BHAWAN, Block ‘A’, GPO Complex, INA, New Delhi- 110023 and should be superscribed “Complaint under The Public Interest Disclosure”. If the envelope is not superscribed and closed, it will not be possible for the Commission to protect the complainant under the above resolution and the complaint will be dealt with as per the normal complaints police of the Commission. The complaint should give his/her name and address at the beginning or end of the complaint or in an attached letter.

6)In order to protect the identity of the person, the Commission will not issue any acknowledgment and the whistle-blowers are advised not to enter into any further correspondence with the Commission in their own interest. The Commission assures that, subject to the facts of the case being verifiable; it will take necessary action, as provided under the Government of India resolution mentioned above. If any further clarification is required, the Commission will get in touch with the complainant.

How to apply under RTI Act?

The following may be noted while submitting requests seeking information under RTI Act:- Arrangements have been made at the Reception Counter of CVC for receiving applications/request seeking information under RTI Act, 2005. Applications/request can also be sent by post alongwith the requisite fee directly to the concerned CPIO in CVC dealing with the subject.  The names of  CPIOs and the appellate authority  are given in this website which may be consulted before forwarding the application to the concerned. The requisite fee along with the application/request could be paid by way of cash against proper receipt at the Reception Counter or by  Indian Postal Order  in favour of  Section Officer, CVC  payable at New Delhi Post Office.  The fee may also be paid by demand draft or banker's cheque drawn in favour of  Section Officer, CVC . The details regarding Rules & Regulations pertaining to fees etc. under RTI Act may be perused in the website of Ministry of Personnel, Public Grievance & Pension. WHISTLEBLOWER PROTECTION

A few years after the murder of IIT Kanpur alumnus NHAI engineer Satyendra Dubey , the CVC launched an initiative to protect whistleblowers. However, this program has been criticized by ex-Chief Justice of India R.C. Lahoti as being ineffective. He said that he had on previous occasions through his NGO India Rejuvenation Initiative, tried to draw the attention of high officials in the CVC to the unsatisfactory manner of its functioning, but with no results
