PREAMBLE

Section 14 of PCS, Act, 1974
The conduct of a civil servant shall be regulated by rules
made by Government (prescribed authority), whether
generally or in respect of a specified group or class of
civil servants.

Extent of application

These rules apply to all persons i.e.,
whether on duty or on leave, within or without Punjab, serving
in connection with the affairs of the Province of Punjab,
including the employees of the Provincial Government
deputed to serve (under the Central Government or) with a
Statutory (legal) Corporation or with a non-Government
employer.

A statutory body is an organization established by the govt. to
regulate certain industries or activities, or public services.
■Examples…. Regulatory (monitoring) agencies (Federal
Reserve, Federal Trade Commission)
■Public utilities commissions -Central banks -Educational
institutions (e.g., universities, colleges) –
■Healthcare organizations (e.g., hospitals, medical research
institutes, environment care units) –
■Professional licensing boards (e.g., medical, legal,
engineering)

Statutory bodies are granted authority by the legislation, and
are responsible for carrying out their duties in accordance with
the relevant laws and regulations.

NOTIFICATION (The 1st September 1966)
No.S(R)2173/1-10/66-S.O.XIII --
In exercise of the powers conferred by paragraph (b) of clause
(2) of Article 178 and clause (1) of Article 179 of the Constitution
of the Islamic Republic of Pakistan, and of all powers enabling
him in that behalf, the Governor of Punjab is pleased to make the
following rules, namely:
1.Shorttitleandcommencement --(1)Theserulesmaybe
called
thePunjabGovernmentServants(Conduct)Rules,1966.
(2)Theyshallcomeintoforceatonce.(1)In these rules, unless there is anything repugnant in the subject or context --
(a) "Government" means the Government of
Punjab;
(b) "Government servant" means a person to
whom these rules apply;

(c)"member of a
GS's family"
includes --
wife, children & step children whether residing with
the GS or not; &
(ii) any other relative of the GS or his wife, when
residing with and wholly dependent upon him;
But does not include a wife legally separated from
the GS, or a child or step-child who is no longer in
any way dependent upon him, or of whose custody
the GS has been deprived by law; and
(d)"Province" means the Province of Punjab.
(2)Reference to a wife in clause (c) of sub-rule (1) shall be construed as
reference to the husband where the GS a woman.

4. Repeal of previous Conduct Rules
The following rules in so far as they applied to the
persons to whom these rules apply are hereby repealed
(cancelled) but such repeal shall not affect anything done
or suffered under those rules:-
(i)The Government Servants Conduct Rules, issued by
the late N.W.F.P. Government;
(ii)The Government servants Conduct Rules 1950, issued
by the late Punjab Government;
(iii)The Bahawalpur State Servants Conduct Rules;
(iv) The Sind Civil Services Conduct, Discipline and
Appeal Rules in so far as they concern the Conduct of
Government Servants. 76/27/2024

(n) MISCONDUCT
(As defined in the PEEDA, 2006) Section 2; clause (n)
(i)Meansconductprejudicial(harmful)togoodorderorservice
discipline;or
(ii)contrarytotheGovernmentServants(Conduct)Rulesor
(iii)conductunbecomingofanofficerandagentlemanor
(iv)involvementforgaindirectlyorindirectly,inindustry,tradeor
speculativetransactionsbymisuseofofficialpositiontogainundue
advantageoffinancialorotherobligationsinrelationtoprivate
institutionsorpersons,asmaycompromisetheperformanceof
officialdutiesorfunctions.

(v) Any attempt to bring outside influence directly or indirectly to bear on
the President (or Governor), the Prime Minster (or Chief Minster), a
Minister, or any Government Officer in respect of any matter relating to the
appointment, promotion, transfer, punishment, retirement or other
conditions of service of a civil servant; or
(vi)making appointment or promotion or having been appointed or
promotedin violation of any law or rules; or
(vii) absence from duty without prior approval of leave; or
(viii)acquittal (release) by a court as a result of an offence involving moral
turpitude or affecting human body; or
(ix)conviction for an offence by a court of law;
(n) MISCONDUCT

CRIMINAL MISCONDUCT
A public servant is said to commit criminal misconductif he is involved
for self or others, in;
Any illegal gratification or remuneration;
Acceptance of a valuable thing without
consideration;
Fraudulent misappropriation of property;
Submission of a false statement of assets, etc.
Abusing of position for pecuniary advantage;
Possession of pecuniary (monitory) resources or
property disproportionate to his known sources of
income;
In the PCA, 1947, the word
‘Public servant’ has been
used instead of ‘govt.
servant’ in order to make
that law applicable to a
very large number of
functionaries of the State
instead of restricting it only
to the limited category of
‘Government servants’.

5. Gifts
(1)No Govt. Servant shall, except with the previous sanction of Govern-
ment, accept, or permit any member of his family to accept, from
any person any gift the receipt of which will place him under any
form of official obligation to the donor.
(2)If the offer of a gift cannot be refused then the gift deliver to the
Government for decision.
(3)If any gift, is offered by the head or representative of a foreign state,
the GS should avoid acceptance of gift. If, however, he cannot do so
he shall accept the gift and shall report its receipt to Government
for orders as to its disposal.

(4)Officers of the rank of Secretaries may accept gifts offered
abroad or within Pakistan by institutions or official dignitaries of foreign
Governments if value of the gift doesn’t exceed to Rs. 50, 000/-.
(a) Gifts up to a value of Rs. 10,000/-(Rupees ten thousand only) may
be retained (free of cost) (BPS-1 to BPS-10) officials.
(b) Gifts valued above Rs. 10,000/-may be allowed to be retained on
payment of 15% of the value (BPS-1 to BPS-10) officials.
(c)Gifts valuing Rs. 400,000/-to 1300000/-more shall be deposited
in Toshakhana, maintained by the Cabinet Division, Cabinet
Secretariat, Islamabad.

6. Acceptance of foreign awards
NoGSshall,exceptwiththeprior/expostfactoapprovaloftheChief
MinisterofPunjabacceptaforeignaward,titleordecoration.
No GS shall encourage meetings to be held in his honouror
presentation of addresses of which the main purpose is to praise him.

goodfaithbyanypersonorbodyofpersonsinrecognitionofhis
professionalservices.

10.Lending and Borrowing
(1)No GS shall lend money to,
or borrow money from,
or place himself under any
pecuniary (financial) obligation to,
any person within (above) the limits
of his authority or any person with
whom he has any official dealings:
(i)Deal ordinary course of a
Joint Stock Company, bank
or a firm of standing or the
HBFC
(ii)or taking loan from personal
friend.
Provided that a Government servant may –
•Every GS shall at the time of entering Govt.
Service, make declaration of movable/immovable
property…shares, certificates, securities,
insurance policies, vehicle, cash & jewelry.

11. Buying and Selling of Movable and Immovable Property
(Omitted)
A GS who intends to transact (manage) any purchase or sale of
movable/immovable property exceeding in value Rs. 1,00,000
with any person/or any co-operative Housing Societies/Govt.
Housing Schemes shall apply for permission to the Government.
No Government servant shall construct a building except with
the previous sanction of the Government disclosing the source
from which the cost of such construction shall be met.

When a Government servant is appointed/transferred to a post from
where he has borrowed money or placed himself under a pecuniary
obligation, or will reside, possess immovable property, or carry on
business within the local limits of such authority, the GS shall forthwith
declare the circumstances, when he is a GazettedOfficer, to Government
through the usual channel, and where he is a non-gazettedGovernment
servant, to the Head of his office.
This rule may be construed (read) to loansgiven to or taken from
Co-operative Societiesregistered under the Co-operative Societies Act,
1925 (Sind Act VII of 1925), shall be subject to take permission from the
Government.

notoriouslyfluctuatingvalueshallbedeemedtobespeculationin
investments.
(2)NoGSshallPermitanymemberofhisfamilytomake,anyinvestment
likelytoembarrassorinfluencehiminthedischargeofhisofficialduties.
15. Take part in the promotion or management of any bank or company
(upon Govt. orders, take part in the promotion of cooperative society).
16. No. GS can be engage in Private Trade, Employment or Work. Except
with the sanction from the Govt. or
associate himself with any private trust, foundation or any institution
which is not sponsored by Government.

20 -No GS shall participate in the editing or management of,
any newspaper or other periodical publication.
21-No GS shall participate in a radio broadcast or television
program, or contribute any article or write any letter, to any
newspaper or periodical:
22. No GS shall make any statement or act which is
embarrassing the Government in any document published.
i. Provided that technical staff may publish research paper on technical
subjects keeping intact the Government policy.
ii.Provided that teaching profession may publish research articles,
letters, books and research material on the subjects related to their
specialized discipline.

The GS may perform honorary work of a
religious or social or charity work or occasional work of an
artistic character,
subject to the condition that his official duties do not thereby
suffer and that the work does not conflict with his position as
a GS;
but he shall not undertake or shall discontinue such work if so
directed by Govt.
(E) Misconduct in Accepting Part Time Employment While
in Government Service

willful abuse of Govt. offices.

part in any political movement.

part in any election, whether in
Pakistan or elsewhere except

(a) Contract with foreign Government
■Where a civil servant was sent on foreign deputation with clear
terms for a specified period, but he entered into new contract with
the foreign Government without consulting or seeking permission
from the Government in his parent department:
■Held that this amounted to wanton act of indiscipline and
misconduct, for which the major penalty of removal from service
was justified.
(b) Joining University Without Permission
An officer will get permission/NOC/apply for study leave before he
joins the university
He did not join duty to apply for permission but continued his
studies at the University.
He was held guilty of misconduct of indiscipline.

(c) Willful Absence –misconduct
A civil servant on medical leave left station without permission.
He sought piecemeal extension on medical grounds, but declined to
appear before Medical Superintendent, nor appeared before the
competent authority for personal hearing: Held, that in the
circumstances absence from duty was willful, and behavior for not
appearing for personal hearing was tantamount to insubordination
and misconduct.
(d) Rudeness on the Part of Subordinates and Superiors
Willful rudeness on the part of subordinate and superiors is
against being a good officer/official.
