Rightofchildrentofreeandcompulsoryeducation
Act(RTE)enactedbytheparliamenton4August
2009.
cameintoforceon1April2010.
“Thestateshallprovidefreeandcompulsory
educationtoallchildrenoftheageof6to14years
insuchamannerasthestatemay,bylaw,
determine.”

Freeeducationisdefinedasfreedom
fromliabilitytopayanyfeetothe
schoolandsuchoftheexpencesasmay
belikelytopreventthechildfrom
participatinginandcompleting
elementaryeducation.

Compulsoryeducationdefinedasthe
obligationofthestatetotakeall
necessarystepstoensurethatevery
childparticipatesin,andcompletes
elementaryeducation.

1.RTEActprovidestoeverychildoftheageof6to
14yearstherighttofreeandcompulsory
educationinaneighbourhoodschooltillthe
completionofelementaryeducation.
2.Itspecifiesthedutiesandresponsibilitiesof
appropriategovernments,localauthorityand
parentsinprovidingfreeandcompulsory
education.

3.Itlaysdownthenormsandstandardstopupil
teacherratios,infrastructure,workingdaysand
teacherworkinghours.
4.Itprovidesforrationaldeploymentofteachersby
ensuringthatthespecifiedpupilteacherratiois
maintainedforeachschool.
5.Itprovidesforappointmentofappropriately
trainedteachers,ie;teacherswiththerequisite
entryandacademicqualification.

6.Itprovidesfordevelopmentofcurriculumin
consonancewiththevaluesenshrinedinthe
constitution.
7.Achildwhocompleteselementaryeducationshall
beawardedacertificate.
8.Ithasopenedthedoorsofprivateschools,by
making25%oftheseatsreservedforthechildren
belongingtothebackwardclassandeconomically
backwardsections.
9.Theactbanscorporalpunishment.

10.Itbansthescreeningprocedureofchildrenfor
givingadmission.Nochild'sadmissioncanbe
rejectedonthebasisofunavailabilityofthe
requireddocuments.
11.Itmakesprovisionsfornon-admittedchildtobe
admittedtoanageappropriateclass.
12.Itprohibitsphysicalpunishmentandmental
harassment,screeningprocedureforadmissionof
children,capitationfee,privatetuitionbyteachers
andrunningofschoolswithoutrecognition.

thecentre,stateandlocalbodiesforits
