Definition of Qisas The word " qisas " ( قصاص ) comes from Arabic which means "to search for traces", such as "al- qasas ". Whereas in terms of Islamic law, the meaning is that the perpetrator of a crime is repaid as he did, if he kills then he is killed and if he cuts off a limb then his limbs are also cut off. While the Shaykh Prof. Dr. Shalih bin Fauzan defines it as, "Al- Qisas is the act (revenge) of the victim or his guardian against the perpetrator of the crime, the same as or the same as the act of the perpetrator earlier." It can be concluded that qisas is taking the same or similar retaliation, similar to the term “debt of life is paid with life”.
Kinds of Qisas Qisas is divided into 2, namely: a. Qisas soul Qisas soul is qisas related to one's soul or right to life such as murder. The discussion on this issue stems from a discussion about the nature of murder and murder, which because of the gathering of these traits with the victim requires qisas . Not all murders can be subject to qisas , but qisas is only imposed on certain people who kill certain people with certain killing methods and certain victims. Q isas there are many lessons, including: 1. Protect society from evil and detain anyone who will spill the blood of others. 2. Realizing justice and helping people who have been wronged, by making it easy for the victim's guardian to respond to the perpetrator as it was done to the victim. 3. Become a means of repentance and purification from sins that have been violated, because qisas becomes kafarah (removal of sins) for the perpetrators.
