WHERE WAS THE ISSUE?
The issue was not with John
Brady's confession, but with his
partners.
HOW?
Petitioner's counsel (in this
case Brady) had requested to
see Boblits extrajudicial
statements.
A statement dated July 9,
1958, states that Boblit
admitted to the murder! This
document was not shown
until after the sentences of
both men.
Once shown to the
counsel, they moved for a
new trial mased on
evidence which was
suppressed, which turned
into
Brady v. Maryland
WHO WAS
IMPORTANT IN
THIS CASE?
•Grew up poor in Southern Maryland
•Parents, who lived on tobacco farm
gave him up to their grandparents
•Suffered from otitis media (ear
infections)
•Dropped out in 8th grade to work on
uncle's farm
•Died in 2006
•Because of the prosecution, he spent
only 16 years in jail instead oflife in
prison or death penalty.

WHO WAS IMPORTANT IN THIS CASE?
•Was the one that murdered William Brooks
•Admitted he was the murderer
•Life was spared when Supreme Court ruled
that death penalty was unconstitutional
•Convicted for rape in 1992 and send back to
prison

•Brady's new lawyer after being put
on death row
•Partner in a large firm
•Eventually went on to become dean
of Colombus School of Law at
Catholic University in Washington
D.C
•Appealed Brady's sentencing for
many years

WHO WAS IMPORTANT IN THIS CASE?
•Was able to push for defendants' rights thanks
to Brady v. Maryland.
•Ends up being the longest-serving justice in
history
•Thought of the constitution as a document
"designed to take the government off the
backs of the people"

THE TRIAL
•Tried for first degree murder, and
sentenced to death
•Brady took the stand and admitted his
participation in the crime
•Brady's first lawyer acknowledged
Brady was guilty of the crime, but that
the jury not give him death penalty
•Prosecution held back July 9, 1958
statement so they can convict Brady
•Once on death trial, he gets new
lawyer, Clinton Bamberger
•They appeal for many years
•The legal issues arose after the
sentencing
•Due to prosecution not revealing that
Boblit admitted to the murder, the
jury and judge thought they both
partook in the murder
•This was not the case however, and it
allowed brady to appeal.

•It also established a constitution obligation for specifically prosecutors
to disclose any and all evidence they have.
•This is to ensure that the defendant has a fair trial.
•Also created a new rule that forced prosecutors to disclose all
evidence to the defense, if the defense asked for it.
•Defined "exculpatory" evidence as any evidence that is very favorable
for the defendant.
PLACE IN LEGAL HISTORY
Brady's rule was a key stone in various
cases. These include:
•United States v. Bagley
•United States v. Agurs
•UnitedStates v. Giglio
All three helped develop the Brady's
rule even further.

HOW BRADY'S RULE CHANGED
OVERTIME
•United States v. Bagley (1985) ruled that
the Brady rule requires any evidence of
impeachment to be disclosed, even if the
defendant doesn't request it.
•United States v. Agurs (1976) ruled that
prosecutors must turn over ANY
exculpatory evidence, even if the defense
doesn't request it.
•United States v. Giglio (1972) ruled that
the Brady Rule applies to ALL prosecutors.

Brady v. Maryland helped give
defendants more rights. These rights are
always changing thanks to cases that
build upon Brady v. Maryland, ensuring
defendants get a fair trial.
