MEMORANDUM OF AGREEMENT
(For Job-Order / Contract of Service –Not an employer–employee relationship)
This Memorandum of Agreement (MOA) is made and entered into this ___ day
of August, 2025, in Zamboanga City, Philippines, by and between:
JOMAJ F. DELA CRUZ in his/her capacity as School Principal of Sinubong
National High School, hereinafter referred to as the “School”;
— and —
NORIEL E. BERNARDO of legal age, Filipino, and residing at Sinubong,
Zamboanga City hereinafter referred to as the “Service Provider.”
WITNESSETH:
WHEREAS, the School requires the services of a maintenance/utility personnel
to assist in the upkeep and cleanliness of the school premises to ensure a safe
and conducive learning environment;
WHEREAS, the Service Provider has expressed willingness to render such
services under a job-order arrangement, without establishing an employer-
employee relationship;
NOW, THEREFORE , for and in consideration of the foregoing premises, the
parties hereby agree as follows:
TERMS AND CONDITIONS
1. Scope of Work
The Service Provider shall perform the following duties:
Cleaning and upkeep of offices and school grounds;
Assistance in repairs and maintenance tasks;
Disposal of waste materials in designated areas;
Other related tasks as may be reasonably assigned by the School.
2. Compensation
The School shall provide the Service Provider an honorarium/allowance of
Seven Thousand Pesos (₱7,000.00) per month, subject to the availability of
funds.
3. Nature of Agreement
This MOA is for service only and does not create an employer-employee
relationship between the parties.
The Service Provider shall not be entitled to benefits under the Labor
Code, including but not limited to SSS, PhilHealth, Pag-IBIG, 13th
month pay, and other statutory benefits.

2. The Service Provider is engaged only for specific services and is not
considered a regular or permanent employee of the School.
4. Duration
This Agreement shall be effective from August 15, 2025 to April 30, 2026,
renewable upon mutual consent of both parties.
5. Termination
Either party may terminate this Agreement at any time upon written notice of
at least fifteen (15) days, for valid or justifiable reasons.
6. Settlement of Disputes
Any disagreement arising from this Agreement shall first be settled amicably.
Should this fail, the matter shall be referred to the proper authorities in
accordance with Philippine laws.
