REPETITIVEINCIDENTSOFRAPE

•Section66.
•Whoever,commitsanoffencepunishableundersub-section(1)or
sub-section(2)ofsection64andinthecourseofsuchcommission
inflictsaninjurywhichcausesthedeathofthewomanorcausesthe
womantobeinapersistentvegetativestate,shallbepunishedwith
rigorousimprisonmentforatermwhichshallnotbelessthan
twentyyears,butwhichmayextendtoimprisonmentforlife,which
shallmeanimprisonmentfortheremainderofthatperson’snatural
life,orwithdeath.

•Section64.(1)Whoever,
•exceptinthecasesprovidedforinsub-section(2),commitsrape,
shallbepunishedwithrigorousimprisonmentofeither
descriptionforatermwhichshallnotbelessthantenyears,but
whichmayextendtoimprisonmentforlife,andshallalsobe
liabletofine.

•Section 64. (2) Whoever,—
•(a) being a police officer, commits rape,—
i.Withinthelimitsofthepolicestationtowhichsuchpolice
officerisappointed;or
ii.Inthepremisesofanystationhouse;or
iii.Onawomaninsuchpoliceofficer’scustodyorinthecustodyof
apoliceofficersubordinatetosuchpoliceofficer;or

•(b)beingapublicservant,commitsrapeonawomaninsuchpublic
servant’scustodyorinthecustodyofapublicservantsubordinateto
suchpublicservant;or
•(c)beingamemberofthearmedforcesdeployedinanareabythe
CentralGovernmentoraStateGovernmentcommitsrapeinsuch
area;or

•(d)beingonthemanagementoronthestaffofajail,remandhome
orotherplaceofcustodyestablishedbyorunderanylawforthetime
beinginforceorofawomen’sorchildren’sinstitution,commitsrape
onanyinmateofsuchjail,remandhome,placeorinstitution;or

•(e)beingonthemanagementoronthestaffofahospital,commits
rapeonawomaninthathospital;or
•(f)beingarelative,guardianorteacherof,orapersoninapositionof
trustorauthoritytowardsthewoman,commitsrapeonsuchwoman;
or

•(g)commitsrapeduringcommunalorsectarianviolence;or
•(h)commitsrapeonawomanknowinghertobepregnant;or
•(i)commitsrape,onawomanincapableofgivingconsent;or

•(j)beinginapositionofcontrolordominanceoverawoman,
commitsrapeonsuchwoman;or
•(k)commitsrapeonawomansufferingfrommentalorphysical
disability;or
•(l)whilecommittingrapecausesgrievousbodilyharmormaimsor
disfiguresorendangersthelifeofawoman;or

•(m) commits rape repeatedly on the same woman,
•Shallbepunishedwithrigorousimprisonmentforatermwhich
shallnotbelessthantenyears,butwhichmayextendto
imprisonmentforlife,whichshallmeanimprisonmentforthe
remainderofthatperson’snaturallife,andshallalsobeliable
tofine.

•Explanation.—Forthepurposesofthissub-section,—
•(a)“armedforces”meansthenaval,armyandairforcesandincludes
anymemberoftheArmedForcesconstitutedunderanylawforthe
timebeinginforce,includingtheparamilitaryforcesandanyauxiliary
forcesthatareunderthecontroloftheCentralGovernmentorthe
StateGovernment;
•(b)“hospital”meanstheprecinctsofthehospitalandincludesthe
precinctsofanyinstitutionforthereceptionandtreatmentof
personsduringconvalescenceorofpersonsrequiringmedical
attentionorrehabilitation;

•Explanation.—Forthepurposesofthissub-section,—
•(c)“policeofficer”shallhavethesamemeaningasassignedtothe
expression“police”underthePoliceAct,1861;
•(d)“women’sorchildren’sinstitution”meansaninstitution,whether
calledanorphanageorahomeforneglectedwomenorchildrenora
widow’shomeoraninstitutioncalledbyanyothername,whichis
establishedandmaintainedforthereceptionandcareofwomenor
children
